24 States Sue Biden EPA Over Water Rule That Would Limit Land Use for Farmers, Landowners

The Biden administration’s Environmental Protection Agency has issued new rules that is substantially a power grab that greatly limits what farmers and landowners can do with their property.

The federal government has always been in charge of bodies of water that are affected by the tide. Now, Biden is trying to usurp state authority over water, which is not affected by the tide. This will leave much of our farmland unusable for raising crops.

Attorney Generals from 24 states are suing them for their unconstitutional power grab. The EPA, filled with unelected bureaucrats is trying to grab the power away from state and federal legislatures.

The Biden administration’s Waters of the United States rule, which was introduced in December and is scheduled to be implemented in March, would change the definition of federal waterways, thus bypassing the states and taking property from farmers and landowners without compensation. They are essentially rewriting the regulation under the 1972 Clean Water Act.

The lawsuit stated:

“The Agencies have sought to expand their own authority by broadly defining ‘waters of the United States,’ a key jurisdictional provision in the CWA.”

The EPA now wants control over ponds, certain streams, ditches, and other bodies of water. Ditches? You have got to be kidding me.

The lawsuit claimed:

“If ‘WOTUS’ is defined more broadly, then more waters and land are subject to rigorous federal permitting requirements, potential criminal penalties for discharges, and much more.”

The states accused the agencies of attempting to redefine WOTUS “in an unlawfully aggressive way” that violates constitutional rights for “ambiguous environmental benefits.”

The lawsuit explained that if the rule was left in place, “ranchers, farmers, miners, homebuilders, and other landowners across the country will struggle to undertake even the simplest of activities on their own property without fear of drawing the ire of the federal government.”

The 24 states taking legal action against the agencies include West Virginia, North Dakota, Georgia, Iowa, Alabama, Alaska, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, Virginia, and Wyoming.

The states requested that the court intervene and prevent the “improper federal power grab over state waters” by setting the rule aside as unlawful.

West Virginia Attorney General Patrick Morrisey urged the Supreme Court to clearly define WOTUS to ensure state waters “are not subject to the whims of unelected bureaucrats.”

Morrisey said:

“This new final rule is a decades-long effort by the EPA to regulate purely intrastate waters without the explicit consent of Congress. This is yet another attempt from unelected bureaucrats to expand their own authority by broadly defining Waters of the United States.”

First create a government agency with a vague mission, such as “to protect you,” then use it to advance a camouflaged agenda.

Another one would be the Dept. of Education, its agenda being to “educate our children.” Who knew, at the time, that “our” meant “theirs.”

Another useless government alphabet organization, that does more damage to the country, than it does good, but is disguised as a group that cares about the people or the environment. The EPA like many of the others need to be abolished.

Correct me IF I am wrong. This PUDDLE, DITCH and POND “rule”, which ARE all on PRIVATE PROPERTY, was attempted under 0bama’s ILLEGITIMATE APPOINTMENT as a pRESIDENT!!

This is how it got started last time.

If they come here and tell me what I can, or cannot, do with my pond ….. they may not leave.
