Trump Indicted for Attempts to “Subvert” the 2020 Election

Special Counsel Jack Smith announced the long-awaited charges today; the indictment is the result of the Department of Justice’s more than yearlong investigation into Trump for January 6, 2021.

By: Julie Kelly, Aug 1, 2023

Former President Donald J. Trump has been indicted by a D.C. grand jury on four counts for his alleged role in instigating the Capitol protest on January 6 and related efforts to prevent swing states and Congress from ultimately certifying Joe Biden as the winner of the 2020 presidential election.

Special Counsel Jack Smith—appointed by Attorney General Merrick Garland in November 2022 to take over the Department of Justice’s existing investigation into “whether any person or entity unlawfully interfered with the transfer of power following the 2020 presidential election or the certification of the Electoral College vote held on or about January 6, 2021”—announced the charges during a brief public statement shortly after 6 p. m. at the Justice Department.

“Today, an indictment was unsealed charging Donald J. Trump with conspiring to defraud the United States, conspiring to disenfranchise voters, and conspiring and attempting to obstruct an official proceeding,” Smith said. “The attack on our nation’s Capitol on January 6, 2021 was an unprecedented assault on the seat of American democracy. It is described in the indictment as fueled by lies.”

The case appears to be assigned to Judge Tanya Chutkan, appointed to the D.C. District Court by Barack Obama in 2014.

Trump responded on Truth Social:

The Allegations

“The Defendant lost the 2020 presidential election,” the 45-page indictment began. “Despite having lost, the Defendant spread lies that there had been outcome-determinative fraud in the election and that he had actually won. These claims were false, and the Defendant knew they were false. But the Defendant repeatedly and widely disseminated them anyway—to make his knowingly false claims appear legitimate, create an intense national atmosphere of mistrust and anger, and erode public faith in the administration of the election.”

Smith named six unindicted co-conspirators in the indictment—four attorneys, one “political consultant,” and one DOJ officials, presumably former acting assistant attorney general Jeffrey Clark.

Much of the indictment focused on the pressure campaign against former Vice President Michael Pence and the so-called “fake electors” stunt tied to numerous Trump associates including Clark and Trump’s election attorney John Eastman—a description of one of the attorneys named as a co-conspirator appears to Eastman—the author of the controversial memo outlining how Pence could use an alternative slate of electors in contested states to replace Biden electors during the January 6 proceedings. Both men eventually could be named as co-defendants in a superseding indictment.

Fake elector certificates were sent to both Congress and to the archives in some instances. Michigan Attorney General Dana Nessel last month charged 16 constituents with various forgery charges “for their role in the alleged false electors scheme following the 2020 U.S. presidential election,” Nessel said in a press release. “These false documents were then transmitted to the United States Senate and National Archives in a coordinated effort to award the state’s electoral votes to the candidate of their choosing, in place of the candidates actually elected by the people of Michigan.”

The “fake electors” plan also is the subject of Fulton County District Attorney Fani Willis’ ongoing investigation into Trump’s allegedly unlawful attempts to reverse Georgia’s 2020 election results.

Donald J. Trump has again been indicted by Special Counsel Jack Smith, this time relating to efforts to challenge the 2020 election. For the first time in American history, a former American president is being indicted for his conduct while in office. The political conduct of then-President Trump has been criminalized. And Special Counsel Smith prosecutes these political acts with novel, if not dubious, legal theories.

In total, Trump faces 4 counts: Conspiracy to Defraud the United States; Conspiracy to Obstruct an Official Proceeding; Obstruction of, and Attempting to Obstruct, an Official Proceeding; and Conspiracy Against Civil Rights.  Read the indictment here

Special Counsel Smith goes to great lengths to unsuccessfully try to paint the indictment as not touching upon Trump’s right to speak publicly about the 2020 election or to contest the election results. Those efforts are unpersuasive for the reasons we’ll address below.

In total, Special Counsel Smith alleges Trump took part in “three criminal conspiracies”:

  1. A conspiracy to defraud the United States by using dishonesty, fraud, and deceit to impair, obstruct, and defeat the lawful federal government function by which the results of the presidential election are collected, counted, and certified by the federal government;
  2. A conspiracy to obstruct and impede the January 6 congressional proceeding at which the collected results are counted and certified (“the certification proceeding”); and
  3. A conspiracy against the right to vote and to have one’s vote counted.

Here are the alleged facts and statutory violations against Trump – which are each addressed with specificity…

The most stupid ignorant people must all now know that in the 2020 elections, Joe Biden (D) won the presidential election. Biden received 306 electoral votes and Donald Trump (R) received 232 electoral votes. In the national popular vote, Biden received 81.2 million votes and Trump received 74.2 million votes.

An easy accomplishment for “the most inclusive voter fraud organization in the history of the country”. His words…. not mine. It doesn’t hurt that the DHS and FBI are a part of it too. Only the stupidest and most ignorant are blinded to that fact.

I am 73 years old and am trying to live on “Social Security” under BIDENOMICS.
Diesel is more than twice what I paid the day before Biden was installed.
I can’t afford to eat and can barely pay my electric bill.

I never donate to presidential campaigns.
If I donate $100 to the Trump Campaign …… I can’t put fuel in my truck this month.
I guess I’m not going to go anywhere this month because I am going to donate to Trump.

Smith should hang for his blatant abuse of power.
Biden should hang for his TREASON of providing aid to an enemy invader.
The entire Biden Crime Syndicate should hang for their High Crimes, Bribery, and Treason.

If our Founders were alive today, liberals and democrats would be dying in droves from acute heavy metal poisoning.
Perhaps we should follow the example set by our Founders.
Read the Constitution, and the rest of the Organic Law of the Republic ….. WE have the Right and the DUTY to throw off an oppressive, over-reaching, tyrannical ‘government’.

What’s this “Organic Law” stuff?
Declaration of Independence
Articles of Confederation
Northwest Ordinance
Constitution

ALL, STILL IN EFFECT
ALL, THE HIGHEST LAW OF THE REPUBLIC

In a strange way, I am thankful for Jack Smith, Merrick Garland, Biden, Robert Mueller, and Andy Weissman.
– And the witches of The View and their friends in the media.
They provide a window into what it had to be like in the 1600s when accused of witchcraft or sorcery.
What were those inquisitors and judges like.
Actually, in places like Salem the Supreme power rested with a judge. The roots of judicial tyranny were planted in America during that period. As was shaming and cancel culture.
This is also a great reveal about the people who support these prosecutions.
If you ever wondered what kind of people called the KGB or the Gestapo on their neighbors.
What kind of people went to the plaza and cheered at the beheadings in France under Robespierre’s red terror.
The mobs who surround the poor condemned women in Iran or Afghanistan and throw stones at their heads as they sit tied up in a hole awaiting the inevitable.
Those people aren’t different biologically from us. They are the same, as were the Germans and Russians who watched others be led away and the people who stood on balconies throwing trash at the Jews who were marched in front of them on the way to the trains.
Those people always existed and will exist. They live among us. They’re on TV every hour yelling like drunken peasants ” Torture her! ” “Burn her” ” Hang him”. The chants of terrorism humanity misguidedly and tragically often confused with justice.
Same with despots and tyrants. Saddam Hussein would have been a gangster if born in the USA, probably in command of a crappy neighborhood where he’d be the scariest thug and Jack Smith would be his henchman if born in Iraq sending people to the torture chambers or the gallows.
People like these were the blood flow of totalitarian regimes, the essence that sustained them, protected them, and spread them.
Plus ca change…
The ideologies that led the civilized world down the path of evil were Marxism and Fascism (which usually was a socio-immune response to Communism). Both are represented in the ideas of the WEF, the Democrats, and those whose interests intersect with theirs when it suits them. The means and methods of these tyrannical and genocidal systems still appear from time to time. Like the J-6 Hearings orchestrated by Mafia daughter, Pelosi, or the Russiagate witchhunt that sent 100s of people into ruin. To the deliberate unleashing of BLM and Antifa (both communist terrorist organizations) to intimidate states and cities into submission to Cultural Marxism.
Times (and people) like this show us the real image the proverbial mirror would show as our true selves as a society or community.
Covid showed us the ones who’d call the Gestapo if you looked mildly “Jewish”.
These Trump prosecutions show us who’d be at the Mall on Sunday waiting for the beheading of the week if we were in the Middle Ages.
The more gruesome the execution, the more the mob cheered.
Drawn and quartered, broken into the wheel, locked in the pillory the mob loved it.
The mob loves it because group behavior is more primal. and because the mob is filled with the fearful who feel that by joining the crowd the powers won’t come for them.
