was also the first to argue that the pandemic had had a significant impact on history by sickening the US president, Woodrow Wilson, at a critical juncture of the Versailles peace negotiations in Paris in April 1919. The result was that the American delegation acceded to

NEW: Judges reading tea leaves after SCOTUS hearing on 1512(c)(2)?

Despite DOJ asking for astronomical sentences for 4 defendants convicted last year on 1512(c)(2) charges and related lower charges, Judge Lamberth went way below sentencing recommendations today.

Lamberth--who recently gave an interview to WSJ and has made in court statements refuting "political prisoners/hostages" statements--not only denied DOJ's newest sentencing enhancement recommendation for 1512c2 but <1/3 of the time the government wanted:

Martinez: 21 months
Warner: 27 months
Kinnison: 33 months
Mele: 33 months

Lamberth denied defendants' motion to delay sentencing pending outcome of Fischer v US but it's very likely a decision will be announced before these defendants have to report to jail.

This also helps support Elizabeth Prelogar's claims during oral arguments that 1512c2 convictions result in an average of 24-26 months in jail. So this could be a very cynical move on Lamberth's part.

But it also illustrates the insane sentences DOJ seeks for this nonviolent obstruction conviction.

1) My chances of getting killed in an auto accident are low - around 1 in 100. Not non-existent, but low.
I took driver’s ed decades ago and have plenty of driving experience, so I have a good knowledge base. I know where I’m going and how to get there.
2) There are road signs and traffic lights and navigation apps that give me even more guidance. I practice defensive driving. I recognize signs of danger. Disabled vehicles on the shoulder, swerving cars, road rage, etc.
3) I’m always on the lookout for threats and can swiftly adjust when I see them. I recognize there’s a scope of risk within my control. I can drive during times when traffic is less busy. I can take backroads. I can delay my drive if there’s inclement weather.

Emma is heroic here. It is a shame on the audience they are not applauding here but rather trying to hide. There was a time when people would stand up and applaud and demand the release of Tsurkov who is illegally kidnapped in Iraq. What a shame. A shame on the audience.
