Pennsylvania House Leaders File Brief to Support Texas in Supreme Court Lawsuit Against Pennsylvania

Pennsylvania’s House speaker and majority leader on Thursday filed an amici curiae brief with the Supreme Court against the state of Pennsylvania and in favor of Texas’s lawsuit against the commonwealth and three other states.

A brief (pdf) filed by Pennsylvania House Speaker Bryan Cutler and Majority Leader Kerry Benninghoff, both Republicans, requests that the Supreme Court “carefully consider the procedural issues and questions raised by the Plaintiff concerning the administration of the 2020 General Election in Pennsylvania.”

“The unimpeachability of our elections requires clear procedures of administration so that everyone gets a fair shake. Unfortunately, outside actors have so markedly twisted and gerrymandered the Commonwealth’s Election Code to the point that amici find it unrecognizable from the laws that they enacted,” they wrote, adding that the state of Texas “raised important questions about how this procedural malfeasance affected the 2020 General Election.”

In the lawsuit, Texas Attorney General Ken Paxton alleged that Pennsylvania, Georgia, Michigan, and Wisconsin introduced changes to election laws, deeming them unconstitutional. The suit also contends that by doing so, those states treated voters unequally and created significant voting irregularities by rescinding certain ballot-integrity measures.

Filed on Monday night, the lawsuit is requesting the Supreme Court to declare the four states carried out their respective elections in violation of the U.S. Constitution.

“The states violated statutes enacted by their duly elected legislatures, thereby violating the Constitution. By ignoring both state and federal law, these states have not only tainted the integrity of their own citizens’ vote, but of Texas and every other state that held lawful elections,” Paxton said in a statement announcing the legal petition.

Cutler and Benninghoff, in support of Paxton’s lawsuit, further stipulated that “under the pretextual guise of COVID-19, special interests began attempting to use Pennsylvania courts” to carry out “election procedures of their own choosing,” citing mail-in ballot extensions implemented by Kathy Boockvar, the Pennsylvania secretary of state.

Also on Thursday, Pennsylvania Attorney General Josh Shapiro filed a brief with the court, arguing that Paxton’s assertions are frivolous and an attempt to “disenfranchise voters” in the commonwealth.

“Its request for this Court to exercise its original jurisdiction and then anoint Texas’s preferred candidate for President is legally indefensible and is an [affront] to principles of constitutional democracy,” Shapiro’s brief read. He further argued that Texas hasn’t suffered harm “simply because it dislikes the result of the election, and nothing in the text, history, or structure of the Constitution supports Texas’s view that it can dictate the manner in which four other states run their elections.”

It makes perfect sense. Ever hear of civil cases where the verdict was “guilty, pay $1 in damages”? This is the same thing. They ignore the mountains of evidence and rule that there was fraud but it didn’t change the result of the election.

This ruling is completely separate from the issue of fraud and how much of it occurred. This issue is whether the state elections laws were changed constitutionally and by state officials that were in authority to do so.

The form of the argument doesn’t change at all. “Yes it was unconstitutional but it didn’t change the result of the election. Suit denied”. Trump still loses and no penalty or censure for said unconstitutional acts will be ordered.

No, that isn’t the form of the argument to begin with. They won’t consider if it changed the outcome or not, they will say it invalidates certification and will throw it back to the state.

Then we need the President to declare martial law and he can declare an insurrection and order a new election in the six states in question. Anyone who is honest knows this whole thing was a coup on our country and we cannot just accept and go on like nothing happened.

No if the ruling determines they broke the law then the election was NOT fair and it will be overturned… You need to study your laws. This is not a matter of just some fraudulent votes this is a matter of a criminal offense in the fact they BROKE THE LAW.

Fair? I’m thinking a Justice, well, a good one, isn’t concerned with fairness as a qualitative but rather if the laws that were passed by the Leguslative branch were followed, given that the laws pass Constitutional muster. That approach is the only way to approach something being fair.

The Judges of the United States Supreme Court’s job is to judge and rule according to the Constitution of the United States of America….. It is not about Courage it is about them doing their JOB. If not then they need to be taken off the bench.

I’ll say this much, with all these states, even Penn., at this point backing this lawsuit, and with all of the evidence that there is to back it, if SCOTUS ‘shytes the bed’ on this one, as we say in Maine, you can damn well expect a full blown rebellion. They don’t dare blow this one off, and they damn well know it.

It is clear that The 4 States in question violated their own State Constitutions by changing Election Law WITHOUT those changes being voted on by their State Legislatures. Unquestionably those Election Law changes were illegal and Unconstitutional by both State and US Constitution. Now we see if John Roberts respects the Constitution. Or not. Of course, Roberts already scheit upon the Constitution when he personally re-wrote Obamacare from the Bench and allowed that Abomination to become Law. Roberts is a Constitutional disaster.

I have been wanting Chief Injustice Roberts to be impeached for a very long time. In my humble opinion his ruling on ObamaCare should be enough to institute those proceedings. It indicates corruption in his life and that should be investigated.

A good law can be plainly written and understood to those pertaining to the rule. Or those who are covered under the law. In this case, the constitution gives plain language and instructions covering American elections.

The military and the politicians take an oath to defend the country against all enemies both foreign and domestic, those who have committed this fraud are our enemies and need to be dealt with accordingly and made an example of if anyone ever tries this again to overthrow the legal voters of our country. This is our country not theirs and they work for us and we going to fire all of them and prosecute those who committed crimes or were accessories to the crimes.

Not a new thought here, but still relevant: The D’s insisted that cheating took place in 2016, and insist a fair election was had in 2020. They are the ones that changed how their states’ voted, to their benefit.

They should not be surprised when they must concede this point. They certainly know they cheated; tried to usurp our democratic right to decide whom our elected officials are.

The constitution is fundamental to everything it creates/authorizes. A law created under the authority of a constitution cannot have more authority than the constitution which authorized it. To reinforce this point our Constitution makes it crystal clear, in Article 6, that it is the “Supreme Law of the Land.”

The Constitution dictates how they run their elections. The Judges of the Supreme Court’s job is to uphold and rule according to the Constitution of the United States of America. Lets pray for their sakes this happens, if not they need to be taken off the bench.

On Monday and Tuesday there was and audit of the Michigan (Dominion) voting machines by an independent auditor. The findings were supposed to be made public Tuesday night. Instead, the Michigan AG filed with a judge to stop the auditor from releasing the information from the audit and the judge ruled in her favor. The information has yet to be released. This was on Lou Dobbs this evening.

I have no doubt she is telling the truth. Her problem is what COURT will hear her and allow her a trial? They seal documents, issue gag orders – anything to keep the public believing there is evidence. They are so close to achieving a victory that they have been working on for decades! COVID was the convenient vehicle to bring this about.

The DEM and RINO JUDGES will continue to dismiss her and the U.S.S.C. doesn’t hear and decide criminal crimes. That is my frustration. You can’t trust the FBI, CIA or DHS to name a few, to properly investigate this and they have endless resources. The opposition to them does not.

I’m trying to be optimistic but the more I think about THEM, the less I am.

The recent U.S.S.C. rulings on LBGTQ+ are not encouraging. With the last one, they let the lower court ruling stand, by refusing to hear it. Now students and adults are forced to be humiliated in locker rooms, changing rooms, bathrooms and showers.

It was easier for them to kick the can down the road than be courageous. Both issues are emotionally charged. Now 39 states are drowning them with pro and con positions on the Texas lawsuits. I guess we’ll just have to wait and see what they do, rather than speculate.

Pennsylvania should move, immediately, to remove the Governor, the AG, and the Sec of State, not only did they commit crimes against the People of Pennsylvania, and of America, they have brought scorn upon what was once a Great State (the state of my birth): Pennsylvania. Ride them out of Harrisburg on a splintered rail after being tarred and feathered. Never allow them to work again in any “public” position.

I agree 100%, as Pa. is my birth state as well. But, alas, Pennsylvania does not have a recall proclamation within it’s founding documents. Our only move is impeachment, but with our SC being heavily leftist, that would fail too.

This is Fantastic!!!, because Seventeen OTHER States also told the Supreme Court on Wednesday that they support the action of Texas Attorney General Ken Paxton.

The states that support the process are:
Alabama, Arkansas, Florida, Indiana, Kansas, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Utah and West Virginia.

By any chance did the weenies in PA come out strongly in favor of this Texas lawsuit because they were afraid that their own constituents would remove them from office their next opportunity because they lacked courage to protect the integrity of the people’s vote? The reason I ask this is because I have been told hundreds of times by conservatives that there is “nothing you can do” to prod your representatives into action. I say they are wrong and the problem with America is the complacency of its citizens.

This case should be open and shut, All 4 states DID in fact illegally have non legislative actor alter election law. That is NOT in dispute and on the merits alone this case MUST as a matter of constitutional law go to Texas. How it will be remedied is the only question, but if the constitution is to be followed that is also pretty clear. The 4 state legislatures can choose the electors, the question is how they will vote

There is ZERO reason to trust the SC on this one either. In 2016 the dims underestimated President DJT. They didn’t manufacture enough phony ballots to overcome his landslide victory.
