Trump asks Cruz to argue Texas case

President Trump has asked Texas Sen. Ted Cruz (R) to present a case from his state’s attorney general seeking to invalidate the election results of several key battleground states before the Supreme Court should it decide to hear the suit, The New York Times reported Wednesday.
The lawsuit from Texas Attorney General Ken Paxton (R) seeks to void the vote certifications of Pennsylvania, Wisconsin, Georgia and Michigan, arguing that the results are “tainted” by new election processes in those states.

White House officials did not immediately return a request for comment from The Hill. The president has for weeks refused to concede his election loss to Joe Biden and has launched legal efforts in multiple states, with no success thus far, to overturn the president-elect’s victory in key battlegrounds.
Legal experts have largely panned the president’s efforts as unserious thus far and have spared no criticism for the latest effort by Trump’s allies in Texas.
“It looks like we have a new leader in the ‘craziest lawsuit filed to purportedly challenge the election’ category,” wrote Steve Vladeck, a law professor at the University of Texas at Austin, on Twitter.
News of the president’s request to Cruz comes shortly after he told his followers Wednesday in a tweet that he would be “intervening” in the Texas case while not specifying what that intervention would look like.
“We will be INTERVENING in the Texas (plus many other states) case. This is the big one. Our Country needs a victory!” the president tweeted.

The Court must hear this case on its merits. This is not a case where the Court has discretion to grant certiorari, but rather a case involving a dispute between/among states, where the Court has original jurisdiction per the Constitution.

That concerns me because the PA situation looked like a sure winner! That one alone had everything in it isolated to PA. Could adding more states to it muddy it up or highlight the obvious fraud going on?
Will they have the COURAGE to hear it and RULE on it?
I am nervous but optimistic on that. They haven’t been to impressive lately with courage…. They prefer avoiding issues and letting lower court rulings stand that are contrary to decency and common sense. We’ll have to wait and see what happens!

The Penn case was internal to Pennsylvania; and the court chose not to involve itself. The appeal to SCOTUS was on the issue of injunctive relief. The Action of the State Supreme Court was refusal of the suit. Just what relief could SCOTUS reply? Would they order the state court to hear the case?

(Nov. 18, 2020) — “When the federal statutes speak of ‘the election’… they plainly refer to the combined actions of voters and officials meant to make a final selection of an officeholder… By establishing a particular day as ‘the day’ on which these actions must take place, the statutes simply regulate the time of the election, a matter on which the Constitution explicitly gives Congress the final say.” Foster v. Love, 522 U.S. 67, 71-72 (1997)
We will take a closer at this binding precedent below, but in preview, please understand that it emanates from a 9-0 decision of the United States Supreme Court, wherein the entire Court joined, not just the outcome, but also the opinion on this very point.
The voters vote. The officials count. These combined actions form “the election,” and the election must be decided on the day. States that failed to make a final selection of officeholder by midnight after Election Day have violated the statute, subjecting the nation at large to the very evils Congressionally mandated deadlines were drafted to prevent.
Federal Election Day statutes were designed to curtail fraud, and to infuse a prima facie sense of integrity in our electoral process. But these States – in failing to obey Congressional deadlines – have flagrantly attempted to preempt federal law.This is certainly prohibited, and this is why the late election results are void.

We can only hope that the supreme court will take this case. However to me it looks like the long in progress Communist takeover/coup is successful and we are going to lose our country. When u-tube publicly announces with no push back from congress that any mention of election fraud on the channel is not allowed and will be rejected, it is time to realize that free speech is already gone.Years ago I said that there will be the great flip. Former Soviet Eastern Europe will be the new America and America will be the old Soviet Union. I am watching this happen in person.and in Eastern Europe there is now far, far more freedom than there now is in America. Ted is a very persuasive and convincing speaker. He speaks with passion and conviction. In addition, he has experience before The Supreme Court. This will come down to how many judges are originalists and how many think the Constitution is living and breathing (malleable). Democrats love to champion unenumerated rights. This is where Joe Biden lives, in the plausible deniable shadows between legal and illegal… His people will no doubt argue the the technical constitutional requirements should be ignored for the “good of the country”

This is a poorly written article, a lot of concentrated misinformation.
First – the pleadings refused by the court were not from pro-Trump lawyers. It was from lawyers representing a state legislator. They were pro Pennsylvania attorneys unassociated with President Trump.
Second – Joe Biden is not President Elect. That is what the challenges are all about.
Then: President is not a party to the Texas action. That is States demanding the votes of their citizens be given equal weight and attention as the votes in other jurisdictions.
Ted Cruz is not an attorney on the Texas action; that will be up to the State Attorney(s) who filed the action. They are likely to accept his involvement – but the amount nature of his involvement will be determined by the attorneys of record, with the general approval of the court who hears the cause.
Again, noting that it has not been accepted by SCOTUS is puerile in the sense that it is a suit by some states involving other states as defendants. Hearing that suit is the duty of the Supreme Court. They are the court of original jurisdiction.
The “widely panned” is factual, but of no consequence. It is also widely appreciated.

A journalist in Canada and a good man, Rex Murphy, in a column wrote: “North American journalism is going to have to engage in a massive repair job, a complete and radical overhaul, if both practice and profession are to retain – any – credibility or respect”.
True enough, but if this profession doesn’t collectively experience a moral overhaul or, more to the point, spiritual conversion in which God and Judaeo-Christian beliefs are embraced, it will not happen and their fantasy-world lies will continue. Journalists are now so deeply into lies, deceit and ‘spin’, and the notion that this is their right, that nothing is going to happen.
Nowadays watching BBC, CBC, CTV or CNN causes my lip to curl in utter disdain and disgust. We might just as well be living in the old Soviet Union with its lies and propaganda.
