Congressman Matt Gaetz Files Criminal Referral Against Facebook CEO Mark Zuckerberg


Washington, D.C. Today, U.S. Congressman Matt Gaetz (FL-01) filed a criminal referral against Facebook CEO Mark Zuckerberg for making materially false statements to Congress while under oath during two joint hearings in Congress on April 10th, 2018 and April 11th, 2018.

During a hearing of the House Energy and Commerce Committee and also a joint hearing of the Senate Judiciary Committee and the Senate Commerce, Science, and Transportation Committee, Mr. Zuckerberg repeatedly and categorically denied his company engaged in bias against conservative speech, persons, policies, or politics and also denied that Facebook censored and suppressed content supportive of President Donald Trump and other conservatives.

In June of 2020 however, Project Veritas published the results of an undercover investigation featuring two whistleblowers who worked as Facebook’s “content moderators,” revealing that the overwhelming majority of content filtered by Facebook’s AI program was content in support of President Donald Trump, Republican candidates for office, or conservatism in general.

“Oversight is an essential part of Congress’ constitutional authority,” Congressman Gaetz states in the letter. “As a member of this body, I question Mr. Zuckerberg’s veracity, and challenge his willingness to cooperate with our oversight authority, diverting congressional resources during time-sensitive investigations, and materially impeding our work. Such misrepresentations are not only unfair, they are potentially illegal and fraudulent.”

The letter refers Mr. Zuckerberg to the Department of Justice for an investigation into the false statements made to Congress while under oath.

Dear Attorney General Barr:

I write to urge you to investigate the conduct of Mark Zuckerberg, CEO of Facebook, Inc., before the United States Congress.

On April 10, 2018, Mr. Zuckerberg testified in a joint hearing of the Senate Judiciary Committee and the Senate Commerce, Science, and Transportation Committee. The next day, Mr. Zuckerberg testified before the House Energy and Commerce Committee. On both occasions, members of Congress asked Mr. Zuckerberg about allegations that Facebook censored and suppressed content supportive of President Donald Trump and other conservatives. In his responses, Mr. Zuckerberg repeatedly and categorically denied any bias against conservative speech, persons, policies, or politics. Mr. Zuckerberg also dismissed the suggestion that Facebook exercises any form of editorial manipulation. However, recent reports from Project Veritas, featuring whistleblowers who worked as Facebook’s “content moderators,” have shown ample evidence of such bias and manipulation.

Two content moderators, Zach McElroy and Ryan Hartwig, both worked on the Facebook content review flow generated by Facebook’s artificial intelligence (AI) program for flagging questionable content. McElroy worked at the Facebook-Cognizant facility in Tampa, Florida and Hartwig worked at the Facebook-Cognizant facility in Phoenix, Arizona.

On June 23, 2020, Project Veritas published the results of an undercover investigation featuring the aforementioned whistleblowers. Their report revealed that the overwhelming majority of content filtered by Facebook’s AI program was content in support of President Donald Trump, Republican candidates for office, or conservatism in general. This alone is already an indication of bias within the platform.

 

Once flagged by Facebook’s AI, moderators reviewed the filtered content, and adjudicated whether it qualified as removable. According to the Veritas report and undercover footage, the adjudicators were outspoken about their political bias against Republicans, and actively chose to eliminate otherwise-allowable content from the platform and from public view simply due to its political orientation. This arbitrary and capricious behavior is not done in good faith, and falls outside of the express intent of §230 of the Communications Decency Act, which affords Facebook liability protection as long as the platform moderates content in “good faith.”

 

Additionally, these facts are in direct contrast to Mr. Zuckerberg’s testimony before Congress where he stated under oath that Facebook is a politically-neutral platform, and that he personally is working to root out any employees who are restricting speech based on Silicon Valley’s overwhelmingly leftist culture.

 

Project Veritas’ undercover footage shows that a great deal of “political speech” supporting the President was labeled “hate speech,” or was considered in violation Facebook’s “Community Standards.” At the same time, speech promoting violence against the President and his supporters was labeled as merely “political,” and was thus allowed to stay on the platform. For example, McElroy captured a shot of a Facebook corporate ruling that an illustration of a hand holding a knife slashing the throat of the President, captioned by “Fuck Trump,” would be allowed as political speech, despite being in clear violation of Facebook’s guidelines. In this case, the guidance to content moderators instructed them to watch for hostility directed at the gallery that posted the image.

 

Facebook’s AI screening content is not politically neutral. Neither are the moderators hired to review content flagged by the AI program. This stands in opposition to Mr. Zuckerberg’s congressional testimony, and violates the “good faith” provision of Section 230(c)(2)(A) of the Communications Decency Act.

Accordingly, I respectfully refer Mr. Zuckerberg to the Department for an investigation of potential violations of 18 U.S.C. §§1001, 1505, and 1621 for materially false statements made to Congress while testifying under oath.

Oversight is an essential part of Congress’ constitutional authority. Customarily, Congress is grateful to citizens who come forward with relevant information in good faith, as the aforementioned whistleblowers have done. As a member of this body, I question Mr. Zuckerberg’s veracity, and challenge his willingness to cooperate with our oversight authority, diverting congressional resources during time-sensitive investigations, and materially impeding our work. Such misrepresentations are not only unfair, they are potentially illegal and fraudulent.

If A.G. Barr would get off his fat tush and do something instead of all the indignant
bluster, I might be cautiously optimistic. So far, I remain unimpressed and thoroughly disgusted with A.G. Barr’s lack of ACTION.

Nor will it. I deleted my account 2 years ago and now ONLY use Gab, which os 100% free speech. If one doesn’t like what someone posts or says, just block and mute them. Easy!

We have a Justice system for a reason, but unless you are in self-defense mode, then you will be a vigilante, I know it sounds appealing to go after these people, but until THERE IS NO LAW LEFT OR LAW-ENFORCERS, then we have to take these things thru the courts. And, when the COURTS become evil and unjust, then we come together as a nation and TAKE OUR COUNTRY BACK, OUR WAY.

But, until then, you are either law-abiding or you are lawless and THAT is your choice. But remember, the latter has consequences.

And may I add that I happen to believe that Trump will back any desperate moves by patriots, but only after he makes a declartion indicating such drastic measures.

I think that is why he is being so benign in his actions. If it were my call in his place, there would be dead commies in all those democrat sh-thole cities, with a bounty system in place to take out previously identified leaders of their local movements for the foreseeable future. The only good commie is a dead commie, and that goes for musrats, too.

Think about this: Brick & mortar voting is golden because police and /or soldiers can identify criminals and wanted people as they approach the building. Not so with mailed ballots, especially in the procedures pushed by the commies.

AGREED!! When the those in authority refuse to uphold the law, and indeed, in many cases condone, defend and support this illegal behavior then all that is left is for good, decent, law abiding citizens to get rid of the vermin that is destroying the very fabric of society themselves.

You are railing against conservatives but Trump supporters are no more conservative than Biden supporters are “liberal”.
Trump is leading a populist movement against globalists, left or right. Every action he’s taken supports this position. it’s a very real thing. Many democratic countries have recently elected right-leaning anti-globalist leaders that share Trump’s views.
The people who voted for these populists don’t care about ivory tower definitions of conservatives and progressives.
When you lose your job to a country that has an annual 500 Billion dollar trade surplus with your own country, it’s visceral. People know when they’ve been screwed and that’s because they have.

My post is clearly aimed at the content in the quote, quoted at the top of my comment, and at any ignorant, anti-intellectual conservative, or non-conservative who agrees with the content of that quote.

Whatever Trump and his supporters stand for, if they are anti-intellectual and filled with contradictions, and if they don’t stand for capitalism, they are no better than the impotent, futile, incoherent, contradictory conservatives. And they will fold just like conservatives.

I agree. I was a Democrat and switched to Independent, but voted for Trump for the very reasons you stated. We need a 3rd SOLID political party: CONSTITUTIONAL CONSERVATIVE PARTY. Right now, the Republican Party has lost its way, lost its ideology that supports the Constitution.

I agree the time is ripe for a 3rd party but I would jettison all of the old language including “liberal” and “conservative”. Both parties have been spewing ideological propaganda for so long, these terms have come to mean the opposite. This didn’t happen by accident. The parties figured out a long time ago that loyalty is bred through fear, not knowledge. Propaganda is designed to instill that fear and undermine a persons ability to think for themselves. The Left has mastered indoctrination but both parties have engaged in it for a long time.
When Trump first decided to run, the Republican establishment’s knee jerk response was he’s not a “real” conservative. Fast forward to 2020. That’s precisely why he’s the President today! He instinctively cut through all of the ideological BS that’s become meaningless to most people and instead he focused on fundamental visceral issues like open borders, the absurd trade deficit with China, and urban decay/crime. People relate to these issues.
For a third party to be viable, it needs to build upon Trump’s approach.

I do NOT consider myself a REPUBLICAN or even plain old CONSERVATIVE. I tell others who ask that I am a CONSTITUTIONAL CONSERVATIVE CHRISTIAN. I belong to NO POLITICAL PARTY, but am registered as an INDEPENDENT who thinks for myself. I VOTE FOR WHOM I WANT TO, NOT WHAT SOMEONE SUGGESTS OR TELLS ME TO.

I think you are dissing a whole group of people who MAY HAVE just awakened, a group of what you call, “conservatives” who have been busy taking care of their families instead of jumping into the fray. YOU HAVE NO IDEA WHAT PEOPLE THINK and if you are listening to POLLS and those foolish PUNDITS, then that makes you more of a fool than middle America.

The very backbone of this country IS THE MIDDLE CLASS, which is exactly the people the DEMOCRATS want to eliminate. The rational self-interested man cannot save himself. Life is eternal not merely temporal. Thus, as is emphasized in 1Corinthians 15, resurrection of our bodies in a glorified state is an essential consequence of following Christ. Christ was not teaching altruism as Ms Rand states but teaching faith in Him. Because we are ALL sinners, the rational, self-interested person can only follow Christ UP TO A POINT in this earth. After that point, it’s all — ALL —in the hands of Almighty God. You can be an altruist or a socialist without having faith in Christ. Having an expanded view of rational self-interest cannot save your soul and your happiness. Even meritorious living ends when you die. When Christ says “deny yourself” he is saying deny yourself in favor of God. Self-sacrifice, not self-sacrifice -enacted-in-your-behalf by a government that claims to be acting on behalf of others is what Christ expects. More needs to be said. Suffice it to say, rational self-interest is legitimate if carried forward by the love for God and humanity — it is LOVE, not a management system that is going to make a difference for eternity.

What about Christ’s resurrection? There were many witnesses. What about his and his apostles’ miracle healings? Were they all self-deceptions by a backward people? Was a man lame from birth merely experiencing a psychosomatic episode that lasted for years? Jesus is the only founder of a faith who died and rose as part of their revelation. Also people with great reasoning powers have posited an invisible realm. The dichotomy between reasoning and superstitious bull crap is not the divide Rand or yourself suggest. As a matter of fact I’m a philosophy professor so more than a few people have agreed that I have considerable reasoning abilities; yet I experience no tension between my faith and my ability to enact logical strategies for understanding complex information.
