AG Barr blasts federal judges who impose nationwide injunctions

Attorney General William Barr blasted federal judges who have issued more than 37 nationwide injunctions during the Trump administration, more than in the entirety of the 20th century.

In a Tuesday speech to the American Law Institute, Barr went after “improper use of nationwide injunctions against policies of all stripes” and said that the use of the injunctions to block policy gives district courts “unprecedented power.”

“One judge can, in effect, cancel the policy with the stroke of the pen,” he said. “No official in the United States government can exercise that kind of nationwide power, with the sole exception of the President. And the Constitution subjects him to nationwide election, among other constitutional checks, as a prerequisite to wielding that power.”

One example he cited was the legal battles over the Deferred Action for Childhood Arrivals program, which offers protections for individuals brought to the U.S. illegally as children, instituted under former President Barack Obama.

He went on to emphasize the magnitude and increase of the injunctions, pointing out that the use of the rulings has increased dramatically since President Trump was inaugurated and contrasted the prevalence of the orders with those under Trump’s Democratic predecessor.

“Since President Trump took office, federal district courts have issued 37 nationwide injunctions against the Executive Branch. That’s more than one a month. By comparison, during President Obama’s first two years, district courts issued

two nationwide injunctions against the Executive Branch, both of which were vacated by the Ninth Circuit,” Barr said.

He added that according to his department’s estimates, federal judges only issued 27 nationwide injunctions during the 20th century.

Lawyering has become partisan driven and mostly by DEMS. The day of being objective and going by the law, regardless of personal politics is nearly dead. Obama stuffed the bench with his lawyers. The ninth circuit court is a mess but that might be changing as McConnell is finally getting some judges through. The D.C. court is stuffed with Obama people. The FISA court was stuffed with Obama appointees and they had no business letting that Russian farce go forward. We are becoming lawless through judges politicizing their decisions. Despotism is becoming more common. The old days of the rule of law are fading. Reaching back isn’t changing what is happening now. I wish people would get their heads out from where the sun doesn’t shine.

I have no confidence in the Supreme Court. With 5-4 decision on obvious issues that is too close.
Obamacare never should have passed but John Roberts made it happen. Kavenaugh is looking squishy.

What Congress is doing is taking away Trump’s executive power and putting him on a leash.
They want all his decisions to be approved by THEM regardless of the separation of powers.
The swamp let Obama go wild and it has become a precedent. Take a look at DACA, That was totally unConstitutional. He made DACA and DAPA a policy. Obama didn’t put it in place with an Executive Order and notice how the swamp never objected and I am including the GOP. Few of the GOP are on Trump’s side. DEMS are determined to govern our country and again the swamp is still not objecting. The GOP knows what the DEMS are up to and how out of line it is. Have you heard any outrage from the GOP? I haven’t. In fact a RINO pops up now and then to side with DEMS This confuses the electorate and keeps lies about Trump alive. We also have a ton of illegals that VOTE here too.

DEMS have no business investigating Trump financials prior to his being President. They couldn’t find anything on him with this Russia crap and you know they looked hard. They know there is nothing there for his earlier business dealings plus he has submitted what he is required to by law to run for President. They want to make sure Trump loses in 2020 and don’t kid yourself, social media will shut Trump down and Trump supporters as it gets closer to the election. They are testing things for censorship and banning people. It has already been shown that tampering with searches and censoring influenced the midterms. Our country is in trouble……

The United States has never seen a pro-American President of this measure since Lincoln Just many leftists, progressives and flaming internationalists. During his term, Lincoln had to employ stern measures, including arrest of journalists, to preserve protect and defend the Union. President Trump has my ringing endorsement to do the same not only to journalists, but obstructive federal justices whose actions threaten the well-being and survival of the nation … the US Marshals can do the job.

Reagan came close but amnesty was a HUGE mistake. So was no fault divorce and not getting rid of the federalizing of education. The blue print was there for the globalists to exploit. Reagan experienced nothing Trump has gone through. Well into his second term, it is clear Reagan has gone internationalist. He enjoyed basking in the Gipper tradition, but Trump has had his head handed to him several times by the Left. Also, at the early end of his term Lincoln lost his life doing right while Reagan went horse-back riding in California.

Let’s not leave out the RINOS preventing him form getting the job done.
Trump’s agenda could easily have been accomplished under Ryan and Mc Connell in the first two yers when we had the majority. Both screwed Trump over. He made a choice to save the Senate and get Judges through thanks to Harry Reid’s nuclear option rule. Ryan could have bribed GOPers to NOT retire and he didn’t do it. We had an unprecedented number of GOPers retiring. I’m just venting. You already know this.

Let me first state that your comment is over-broad. What Barr is referring to is that these judges, most, if not all, who were once practicing attorneys are involving themselves in the legislative process when they have granted those injunctions. What I believe they should have been doing is refusing the requested injunctions and stating that the issue should be raised in legislation and that would be the responsibility of the elected legislators. Had they had the courage to do something like that, when the case merited that kind of response, just maybe we would not have gone thru over two years of incivility and divisiveness that has enveloped this nation. Furthermore, lawyers generally protect the citizens of this country from being trampled on, whether you agree with their case or not. They tend to protect us from despotism and violation by those in power. Do not sell that profession short.

I recently read a fascinating and disturbing article (based upon a book) ‘From Democracy to Judicial Dictatorship – ‘. It’s subject was Canada, but evident is that the same problem afflicts the United States. The judiciary is out of control and in Canada parliament was a major contributor when surrendering to courts the legislative process. I doubt there are any longer sufficient individuals in now pansified, politically correct, apathetic and complacent Canada to challenge what is taking place, but possibly there are more Americans with rebellious spirit, a sense of moral outrage and the moral fibre to do something about what is taking place and save the United States from the traitorous left. Citizens need to band together, organize and fight back against the disgusting left with its programme of cultural Marxism and out of control courts. If they do not they will lose their liberty just as the people of Russia did when they failed to fight back against the savagery of first Lenin and his Bolsheviks and then Josef Stalin. This is what Aleksandr Solzhenitsyn had to say on this matter: ““And how we burned in the camps later, thinking: What would things have been like if every Security operative, when he went out at night to make an arrest, had been uncertain whether he would return alive and had to say good-bye to his family? Tilt–I have a lil hard time with the fact that the Repubs. held back and did NOTHING while Obama almost destroyed the Constitution. It also seems as if they are letting Pres, Trump stand on his own with almost NO help. I’m 87 had have seen a lot but NOTHING like what’s goin’ on now. We, the people, have either slept or refused to pull our heads outta where the sun don’t shine. This is on US, damn it!! Will the American public wake up or wait til we’ve lost our Country?? When the observer looks at America’s deep state and how that seems to be a rule unto itself, and then looks across the pond to the UK at the mess the deep state elite are making of BREXIT, the understanding must dawn that the mirage of “democratic control” of the executive by the exercise of the popular will has been just that, a mirage for all these years.

In both cases, our democracy is badly corroded and plainly not functioning properly. We need better newer people plus a better way of filtering out those who use their powers to plot or cause national harm.

Insider trading wasn’t illegal for members of the House or their staff until 2012. Moreover, even with The “Stock Act”, although members of Congress are not explicitly exempt from insider trading laws; the difficulty lies in applying the laws, as they are written and have been historically interpreted by the courts, to members of Congress. This is a classic example of a legal loophole. … Ain’t THAT a hoot?

These injections are phony and a bluff by politicized judges who are only empowered to issue injunctions to the named plaintiff in a case, not nationwide. Its a judicial farce that has long been ignored and not challenged. They were also rare, and those who were issued based on sound judicial precedent or unambiguous legislation unlikely to be challenged. These Current injunctions encourage forum shopping and politicize the judiciary, allowing plaintiffs to hand pick a single district-court judge who can then set policy for the nation. (It was no coincidence that Obama’s policies were challenged in the “red state” of Texas, and Trump’s in the “blue states” of California, Hawaii, and Maryland.) These nationwide injunctions are inconsistent with a judicial system that denies precedential value to district court decisions and typically requires named plaintiffs to meet class-certification requirements before obtaining relief on a collective basis. They also put pressure on the Supreme Court to decide cases before they have been thoroughly debated in the lower courts. Courts should enjoin defendants from enforcing a law only against the plaintiffs in a particular case. We also are about to encounter a situation where different judges issue conflicting injunctions. Which is effective and which is not?

This is called lawfare and is part of Obama’s sinister “resistance” initiative designed to sabotage President Trump’s America-first policies. During his terms Obama politicized and weaponized the FBI, the CIA, Treasury, State, and the courts. Our Founding Fathers never imagined a seditious anti-American President in the White House whose hope was to change America and destroy it from within. President Trump is tasked with protecting the Constitution, erasing Obama’s anti-American imprint, and opposing Obama’s well organized “resistance” legacy designed to overthrow him. Hopefully, Attorney General Barr will help end judicial tyranny and restore the Constitutional balance of power.

Barr’s comments will fire up the Democrats, as they try to discredit him as a pawn of President Trump. These are dangerous times for America. We have a Democrat Party that is becoming Socialist, We have Democrat members of Congress who despise Jews and Christians, but the Democrat Party is unable or unwilling to limit their power. We have an education system and media that support whatever the Socialist/Democrat Party says and does. We have a Federal Judiciary that over the years has been stacked with extreme leftist Judges, who seem to feel that the Judiciary has more power to decide policies than any other branch of Government, especially today when they go after so many of President Trump’s policy decisions. It is as if they have not bothered to study our constitution at all.

And, we have one man, President Donald Trump, who stands in their way. His language is not very statesmanlike at times, and he sometimes tweets too much, but his only interest is to keep America from falling into the Socialist black hole as too many failing states have.

Only God can save America and its allies in the world, and I pray every day for that. Amen!

When the Judiciary oversteps its bounds, it should be the Congress (meaning both house and senate) that stops them. When they rule in violation of their jurisdiction, there is no mandate that they be obeyed. This last item is why President Trump can ignore most of their rulings. Any attempt by those activist marxist judges can be negated by the Presidents own Secret Service and/or Federal Marshall’s against the courts enforcers.

Read the Constitution….. the Congress can Impeach and replace the entire Judiciary sans the Black-robed priests called the SCOTUS.

We are in a constant Constitutional crises starting in 2008 and continuing. Congress, indeed are entire system is dysfunctional at this point. It’s CONGRESS and about half to 60% of the Judiciary that should be impeached actually. As well as the FBI and DOJ disbanded ( they are NOT in the Constitution btw).

Laws CANNOT be made or altered by “judges”!! Laws are made and unmade in CONGRESS ALONE!! The Executive Branch CANNOT MAKE or CANCEL LEGAL LAWS MADE IN CONGRESS! HOWEVER, the Executive Branch can REFINE or MODIFY to CORRECT a LAW that was MADE in CONGRESS.
These “judges” who are OVER-REACHING their authority MUST be hauled before the “bar” and either be REPRIMANDED with a LETTER placed in their FILES and about one year of hiatus and FORCED to study the Constitution followed by a test, – – OR – – be DISMISSED AND DISBARRED from every court in America.

Need to bring in an Executive Order to put Judges in their pkace abd carty out the rule of government to the Constitution. For a Judge to over ride the Constitution one must have good reason. For now Judges who disregatded the Constitution need to be put in the dock.
