St. Louis Files Charges Against Couple Defending Their Home From Violent Mob

Mark and Patricia McCloskey have been charged with unlawful use of a weapon.  From the story: The unlawful use of a weapon charge is a class D felony and could result in one to four years in prison as well as fines up to $5,000. Sources tell 5 On Your Side Gardner’s office will be issuing a summons for the couple to appear in court (KSDK).  It’s clearly politically motivated (Twitter).  Form John Zmirak: If the Democrats win in November and take the Senate and gut the Second Amendment, packing our courts, what happens then? These are the fundamental, literally life or death, freedom or slavery issues we face today. And President Trump needs to run on them (Stream).  Video of Missouri AG Eric Schmitt committing to dismiss the charges (Twitter).

… to be fair to the lab

… someone leaked that information out of that lab – so they had to come clean on it –

… and if the DA finds out who – that person will be cancelled – and likely charged

… and knowing *conservatives* on our side

… that person will not be hired by any other evidence lab in the country

I know professionals who have been destroyed for less.

It is called menacing or brandishing a weapon in public, even though it is on their own property. No one else had a weapon that I can see.

Now, I am FOR THIS COUPLE and I am rooting for them 120%, but in our CCW class, we were taught what to do and what not to do and this is NOT what you are supposed to do. If that crowd had actually tried to get into their home, that would be different and lawful, but they were not.

NO, I AM IN NO WAY FOR BLM/ANTIFA OR ANY OTHER LIBERAL SLUG. But, if we are being HONEST here, the mentality today is US AGAINST THEM and that is not what America is, even though THIS IS EXACTLY WHAT THE LEFT WANTS and if this keeps up, they will get it.

If anything, this couple will be fined or charged with a misdemeanor for brandishing firearms in public view, even though one was inoperable. It makes no difference, if it threatened and/or intimidated these people where it terrified them that this couple would shoot someone, the Grand Jury may just make examples of them.

AND, THIS IS HOW THE LEFT WILL WIN AND WE CANNOT ALLOW THEM TO DO THAT. I ALWAYS SAY BE PREPARED, BUT DO NOT LET ANYONE ELSE KNOW. DO NOT FLAUNT IT. BE KIND AND NICE because YOU have the upper hand in your ability to CONTROL YOURSELF against all odds. THEN, when they go after you, THEN you can defend yourself. DO NOT BE A VIGILANTE.

SO, know the local laws and follow them.

You cannot and should never show your firearm in public view, even if someone comes to your door unless you have a CCW permit and/or your State allows OPEN CARRY and the gun is holstered. THAT IN ITSELF, WILL SEND A BETTER MESSAGE THAN THIS COUPLE DID, even though it may look heroic to you, it was not to me.

IF the crowd or persons try to break in to your home or attack you, then you have probably cause. I know it sounds defeating, but there ARE ways around this, as long as it is now with a CROWD around that will testify against you.

I REPEAT:
You cannot and should never show your firearm in public view, even if
someone comes to your door unless you have a CCW permit and/or your

So what is the statute in MO that states that? BS as even in AZ we are allowed to point and tell people that we will use our weapons IF the need arises. And the Castle Doctrine protects the gun owner as it is THEIR perception of whether or not they feel their lives may be in danger or fear for their lives. But do look up the brandishing a weapon and maybe check what each state says when they address it. I can stand anywhere on MY property with a gun and point it where I wish.

Go back and read MO statute 563.031, Use of force in defense of persons. And then read 571.030, Unlawful use of weapons — exceptions — penalties.

I saw these charges coming from a mile away, none of the protestors were on their personal property and all the protesters were doing at this point was trespassing or possibly B&E because they broke a gate to gain entrance to the private property that this residential estate comprises?

Well it does matter from state to state. MO statute says you may not point your weapon unless you feel threatened. The pictures show these POS on their private property and besides that public or private didn’t matter to those black little moronic criminal terrorist anyway. And all states claim that when you break the plane of someone’s property then you have entered it. And to enter someone’s property legally every state will say that you have a LEGAL purpose to be there be it business or personal. And states that don’t have the castle doctrine usually claim that you have to run and hide and never defend yourself unless it is the last resort. That is the biggest BS for an American to run and hide like a scared rabbit instead of defending yourself.

Did you miss the part that they TOLD THEM WHAT THEY WERE GOING TO DO TO THEM, THEIR DOG, AND THEIR PROPERTY?
So by your argument they should have waited until they were attacked, their dog killed, and their property vandalized and set on fire…….then they could defend their lives and property?

I usually agree with you on most issues, “Mud”….but we are polar opposites on this issue.

Someone tells me what they are going to do to me, my beloved pet, and my property….and they just showed their unlawful aggression by tearing down a barrier to my property…..I’m going to shoot first and ask questions later.

Castle Doctrine applies in Missouri to and extends past self protection and is “expansive” and includes private property. It is clear they were threatened. Property damage is evidence, I would think, to show it was far from peaceful protesting.

They pay a fee to support all community property. This is a requirement when living in a gated community. That fee supports upkeep of common areas, security, trash collection, and other things approved by the community.

When the gate shown in the photo is repaire, it should be replaced with a MUCH heavier one generously decorated with sharp pointed spikes top to botton and the gate should be under constant surveilance by two well concealed securiity cameras monitored by at least one armed guard!!!

First, the Gov has already said he is going to pardon them.

Second, once they broke my “barrier” (gate), I would be pointing a gun at them…..then they threatened the couple with bodily harm and said they would kill their dog. That is provocation and probable cause to get your weapons. They told them what they intended to do…..

Third, I hope the Gov does pardon them….and then deputize them….then they can carry their weapon everywhere.

What good would it do to know those laws if others are already breaking them and threatening you?
Those are great things to teach in a civil society where everyone follows the laws. But rioters, looters, and killers don’t follow any laws.

Thanks. Interesting to note, my paternal grandfather was border patrol there for about 40 years out of EL Paso. His son, my Mom’s first husband, is my natural Father. He was a skunk, but the rest of my EL Paso family is great.
I used to spend my summers in Texas with that side of the family.

I tell you what he told me one time….he said that when Mexican women came across the border to have a baby on our soil they would pick her and the baby up, hand her a piece of paper saying the child was born there and then put both of them back across the border.

When the child got to be eighteen they could apply to come back here, pass a criminal test, go through the citizenship classes, learn English…and if all was well, they could stay.

That should be how they handle it today.

I had family all over Texas….Pilot Point, El Paso, Dallas, Midland, Odessa, etc. But I loved my summers in El Paso the most.

Texas has turned blue in many areas…. and supposed conservative Gov Abbott is giving carte Blanche to County Judges ( they are all the Democrat ones BTW) to do whatever they want to do…. during the “crisis”. In some areas these Judges want to be able to arrest, fine and even jail folks who step out of their houses without a mask !!

They sent an MRAP and heavily armed “deputies” against a Bar owner in Odessa in May for instance.

I did the same thing to the Gov of Tennessee, the Mayor of Nashville, and the Chamber of Commerce when the Governor talked about cutting the police force.
I told them my family had planned a family reunion in Nashville in the summer….and since we won’t be protected there while site-seeing….we decided to cancel.
I said we were going to take our thousands of dollars of the group of 21 and spend where they had law enforcement on the job.
The Chamber lady said a little nervously: “Well that hasn’t been decided yet.”
I said: “Well, let us know what you guys are going to do up there in Nashville. If it’s not too late for us to cancel the other place we planned to go ….maybe we’ll come there.”

Folks….we have got to start hitting them where it hurts….their budgets. If enough people do that, they will have cut their staffs and not take their vacations. Or have those big self-serving conventions in an exotic places. :0)

Unfortunately MANY parts of Texas are now Blue and Gov Abbott is allowing local Democrat County Judges to have complete control….including stripping people’s Constitutional rights ( because “emergency powers” etc).

Texas has changed…… It is NOT what folks think. We are strongly considering relocating.

I am involved in the GOP…. was in Calif for many years. I saw it turn into RINO-Central. Obviously Abbott is the same.

Too late for Austin, Houston and Dallas too from what I can see.

I’ll give you the benefit of the doubt that you think you are trying to help. But in essence what you are saying is…. don’t even have a gun…. because the law will punish you.

It is called menacing or brandishing a weapon in public, even though it is on their own property. No one else had a weapon that I can see.

Now, I am FOR THIS COUPLE and I am rooting for them 120%, but in our CCW class, we were taught what to do and what not to do and this is NOT what you are supposed to do. If that crowd had actually tried to get into their home, that would be different and lawful, but they were not.

NO, I AM IN NO WAY FOR BLM/ANTIFA OR ANY OTHER LIBERAL SLUG. But, if we are being HONEST here, the mentality today is US AGAINST THEM and that is not what America is, even though THIS IS EXACTLY WHAT THE LEFT WANTS and if this keeps up, they will get it.

If anything, this couple will be fined or charged with a misdemeanor for brandishing firearms in public view, even though one was inoperable. It makes no difference, if it threatened and/or intimidated these people where it terrified them that this couple would shoot someone, the Grand Jury may just make examples of them.

AND, THIS IS HOW THE LEFT WILL WIN AND WE CANNOT ALLOW THEM TO DO THAT. I ALWAYS SAY BE PREPARED, BUT DO NOT LET ANYONE ELSE KNOW. DO NOT FLAUNT IT. BE KIND AND NICE because YOU have the upper hand in your ability to CONTROL YOURSELF against all odds. THEN, when they go after you, THEN you can defend yourself. DO NOT BE A VIGILANTE.

SO, know the local laws and follow them.

You cannot and should never show your firearm in public view, even if someone comes to your door unless you have a CCW permit and/or your State allows OPEN CARRY and the gun is holstered. THAT IN ITSELF, WILL SEND A BETTER MESSAGE THAN THIS COUPLE DID, even though it may look heroic to you, it was not to me.

IF the crowd or persons try to break in to your home or attack you, then you have probably cause. I know it sounds defeating, but there ARE ways around this, as long as it is now with a CROWD around that will testify against you.

Agreed. What part of “shall not be abridged” in the Second Amendment do the local authorities not understand?

It wasn’t the wisest move for Mr. McCloskey to brandish an unloaded AR-15 or for the Mrs. to wave a fake handgun but the thugs got the point. The case will be dropped.

It is better to have a gun and not need it than to need a gun and not have it .

Some friends of mine and I have an active shooter drill on hand for school and especially church.

The shooter only gets a first victim once and then it’s “Katy, bar the door”.

So, if the shooter misses with the first shot or just wounds you or shoots another family member or neighbor, you intend to do nothing until you or all are dead? If you say run or call the police, you will confirm your ignorance. You cannot outrun bullets and you’ll be dead by the time the cops get there.

I either carry a concealed weapon on me everywhere I go, especially to church. Living in a rural setting, a loaded weapon is always nearby.

Per my own advice, I drill at the range where I am a member.

In an armed confrontation, my money is on me. He who shoots last lives to shoot another day.

Outrun a bullet? An experienced shooter wouldn’t verbalize such ignorance.

It is good question. I heard this “mostly peaceful protest” phrase from main stream broadcasts, such as CNN, NYT, MSNBC, Wash. Post, Fox News and others. I think that means that protest itself is peaceful, but at the end everything gets broken and burned to the ground.

They will never find a jury that will convict. I don’t know where there is a statute on the books that will not support a home owner protecting his home. It does not exist. Waste of tax payer money. Note, there were no police to turn to. The home owners best belief is that his property and life were in danger. I just do not see a conviction.

Ms. Gardner issued a search warrant to confiscate the firearms the McCloskey’s used to defend themselves.

This couple is being used by Gardner and the other members of the St. Louis Left in exact accordance with the teachings of Saul Alinsky in his book, Rules for Radicals, in which Alinsky tells the reader to “let no crisis go to waste”. This couple is being so viciously and wrongly prosecuted to set an example; to make the American public afraid to use their Constitutional rights to defend themselves and their property.
I hope that this couple gets a good lawyer and sues Gardner and the others responsible for this ridiculous, atrocious attack OUT OF EXISTENCE!!!

This couple both of them attorneys did nothing wrong!!! the hooligans already broke a gate to enter their property and they had all the rights to defend themselves.
BTW, the police found that the guns were not loaded with bullets and they found no bullets at the home. So these people used toy guns to “protect themselves”. Where is the crime??

Some advice I heard from a swat officer, never go out to confront a violent mob on your yard, you can be attacked from various positions, stay inside house, then the mob has to funnel itself through a door, making it easier and safer to shoot them, plus you will be totally legally justified.

As I understand it …… these two are liberal lawyers who have made their ‘fortune’ with ‘social justice’ type cases ….. perhaps the charges against them are “social justice”?
However, that being said …….. It is your RIGHT to go armed on your own property and to defend your property – these THUGS were burning & looting and this couple had every right to believe that they were in direct & dire danger.
Those bringing these “charges” really need to read the Constitution they are SWORN TO UPHOLD & DEFEND.
