Finally, justice has been served. No thanks to Supreme Court Chief Justice John Roberts. Roberts, believed to be a conservative, called the individual mandate a “tax,” even though then President Obama insisted it wasn’t. Had Roberts done his job, ruling based on American law, socialism in the form of Obamacare would never have been foisted on the American people. Chief Justice John Roberts sided with hard-left Justices Ruth Bader Ginsburg, Sonia Sotomayor, Stephen Breyer and Elena Kagan to uphold the law as a valid exercise of Congress’s power to tax. 

Let’s hope the cowardly Chief Justice does the right thing this time around, instead of trying to remain in the good graces of DC society circles.

A U.S. federal judge in Texas ruled on Friday that the Affordable Care Act, known as Obamacare, is unconstitutional, a decision that was likely to be appealed to the Supreme Court.

U.S. District Judge Reed O’Connor in Fort Worth agreed with a coalition of 20 states that a change in tax law last year eliminating a penalty for not having health insurance invalidated the entire Obamacare law.

President Trump responded to the ruling on Twitter with glee.

He first tweeted shortly after 9 pm, ‘As I predicted all along, Obamacare has been struck down as an UNCONSTITUTIONAL disaster! Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions. Mitch and Nancy, get it done!’

He followed that up eight minutes later with a second Tweet.

‘Wow, but not surprisingly, ObamaCare was just ruled UNCONSTITUTIONAL by a highly respected judge in Texas. Great news for America!’

O’Connor’s decision was issued the day before the end of a 45-day sign-up period for 2019 health coverage under the law.

‘The Individual Mandate can no longer be fairly read as an exercise of Congress’s Tax Power and is still impermissible under the Interstate Commerce Clause — meaning the Individual Mandate is unconstitutional,’ the judge wrote. ‘The Individual Mandate is essential to and inseverable from the remainder of the ACA.’

‘Without [the individual mandate], Congress and the Supreme Court have stated, the architectural design fails,’ according to O’Connor. ‘It is like watching a slow game of Jenga, each party poking at a different provision to see if the ACA falls.’

A year ago, Trump signed a $1.5 trillion tax bill that included a provision eliminating the individual mandate.

In the 55-page opinion, O’Connor ruled Friday that last year’s tax cut bill knocked the constitutional foundation from under ‘Obamacare’ by eliminating a penalty for not having coverage.

About 11.8 million consumers nationwide enrolled in 2018 Obamacare exchange plans, according to the U.S. government’s Centers for Medicare and Medicaid Services.

The coalition of states challenging the law was led by Texas Attorney General Ken Paxton and Wisconsin Attorney General Brad Schimel, both Republicans.

Republicans have opposed the 2010 law, the signature domestic policy achievement of President Donald Trump’s Democratic predecessor Barack Obama, since its inception and have repeatedly tried and failed to repeal it.

The White House hailed Friday’s ruling, but said the law would remain in place pending its expected appeal to the Supreme Court.

‘Once again, the president calls on Congress to replace Obamacare and act to protect people with preexisting conditions and provide Americans with quality affordable healthcare,’ White House spokeswoman Sarah Sanders said in a statement.

In June, the Justice Department declared the healthcare law’s ‘individual mandate’ unconstitutional in federal court.

The decision was a break with a long-standing executive branch practice of defending existing statutes in court.

Did you notice how John Roberts QUICKLY went to Hawaii to lecture after he was the swing vote for it?
Obama has something on Roberts. Obamacare is clearly unConstitutional. He looks bisexual….He has that look….There is also the problem with the adoption of his kids….

I don’t think the Supreme Court will want to push it further.
Obama has something on Roberts…. His behavior towards Trump and his rulings on homosexual marriage and Obamacare are suspicious to me……….

Been an outsider looking in, I would say a good thing to get rid of it not been a cut and dry clear health care costing many more or uninsured.

If Chief Justice John Roberts declared the AHCA a tax in 2010, he may do so again. Otherwise, he would contradict himself.

I’d bet they won’t hear it. With the mandate being removed in the spending bill and now another federal judge bringing it over the finish line, there is nothing more for them to hear UNLESS the Supreme Court is going to OVER RULE the SWAMP and become a dictator. We’ll see.

This ruling will be appealed then the Supreme court will rule. Let’s not forget Roberts ruled was Constitutional in the last ruling of the Supreme Court over Obamacare.

The mandate is gone! Without the mandate, there is nothing they can do to change that
SWAMP ruled on that. Remember the swamp gave us Obamacare. The U.S.S.C. shouldn’t be over ruling the SWAMP on that. They are supposed to have a different focus.

The unaffordable health tax was designed to fail by Jonathan Gruber and Ezekial “Zeke” Emanuel (Rahm’s older brother) in order to nudge us all into a soviet-style single payer health care system. First they had to pass the bill to know what they put in it (check). Second they had to addict people on the free stuff elixir of pre-existing condition coverage (check). Third they had to addict people on the free stuff elixir of subsidies for me but not for thee (check). Fourth they needed a cooperating judge to push the bill into the deep blue sea (check). For the fifth and final nudge, they will rally all those they have addicted to other people’s money to protest most energetically that unless Congress passes a total government control of our healthcare system bill everyone, including the children, will die. In lockstep the demonicrat evil party will all approve and the RINOcrat stupid party will go along to get along because freedom is just too hard ya’no (check). The President, who has already asked Congress to fix heathcare to spite the Texas Judge’s ruling, will sign the bill. The last nudge will be shackling all of us yearning to breathe free and shipping us to the Ministry of Truth, Justice, and Reeducation’s special needs camps where the penalty for failure is expulsion with extreme hostility (Checkmate). Already the voices crying in the ‘we demand free healthcare wilderness’ are weeping for gum’mint to fix another problem gum’mint caused. Be afraid. Be very afraid.
