Illinois state lawmakers seek more than $41B in federal coronavirus aid — including $10B pension bailout

Illinois Senate President Don Harmon says the shutdown could undo the progress the cash-strapped state has made in improving its financial footing.

Illinois Senate Democrats are asking the federal government for more than $41 billion in federal aid — about a quarter of it for a pension fund bailout — to keep the state financially afloat as the coronavirus pandemic continues to slash revenues across the board.

A letter from Illinois Senate President Don Harmon, addressed to U.S. Sen. Dick Durbin, went out Tuesday to Illinois’ entire congressional delegation — a day before Gov. J.B. Pritzker announced the economic shutdown would result in an estimated $2.7 billion revenue shortfall in the state’s current budget.

“I realize I’ve asked for a lot, but this is an unprecedented situation, and we face the reality that there likely will be additional, unanticipated costs that could result in future requests for assistance,” Harmon wrote on behalf of the state senate Democratic caucus.

Harmon’s federal wish list for the second phase of federal coronavirus relief includes $15 billion in block grant funding to shore up the state’s spending plans for this fiscal year and the next two.

The Oak Park Democrat also asked for $10 billion for the state’s desperately underfunded pension plans.

The Illinois Republican Party slammed that request on Twitter, accusing Democrats of “brazenly using a global pandemic as an excuse to ask the [federal government] to bail them out of the fiscal disaster they manufactured over the last two decades.”

Harmon also wants $9.6 billion for local governments, $6 billion for Illinois’ overloaded unemployment insurance system and $1 billion in public health support for “historically underserved communities,” apparently referring to African American communities that have suffered a disproportionate brunt of the state’s COVID-19 deaths and cases overall.

Illinois received about $2.7 billion in federal aid for costs related to the pandemic as part of the initial Coronavirus Aid, Relief, and Economic Security Act, which also sent about $2.2 billion to local municipalities.

I hope our President sees to it that they get nothing in the way of Federal funding. They’ll pocket some and waste the rest. Once upon a time, we DID have line item veto but that was taken away by the United States Surpreme Court. So that is why PORK gets through. They will give Trump something he wants and then load it up with PORK. Both parties do it. The last bill put through in record time had MORE money for PORK than for small business and the purpose of the bill.

On April 9, 1996, Clinton signed the 1996 Line Item Veto Act,1 which had been ushered through Congress by Sens. Bob Dole (R-Kansas) and John McCain (R-Arizona), with the support of several Democrats.

On Aug.11, 1997, Clinton used the line-item veto for the first time to cut three measures from an expansive spending and taxation bill.2 At the bill’s signing ceremony, Clinton declared the selective veto a cost-cutting breakthrough and a victory over Washington lobbyists and special interest groups. “From now on, presidents will be able to say ‘no’ to wasteful spending or tax loopholes, even as they say ‘yes’ to vital legislation,” he said at the time.

But, “from now on” wasn’t for long. Clinton used the line-item veto two more times in 1997, cutting one measure from the Balanced Budget Act of 1997 and two provisions of the Taxpayer Relief Act of 1997.3 Almost immediately, groups aggrieved by the action, including the city of New York challenged the line-item veto law in court.

On Feb.12, 1998, the United States District Court for the District of Columbia declared the 1996 Line Item Veto Act unconstitutional, and the Clinton administration appealed the decision to the Supreme Court.4

In a 6-3 ruling issued on June 25, 1998, the Court, in the case of Clinton v. City of New York, upheld the District Court’s decision, overturning the 1996 Line Item Veto Act as a violation of the “Presentment Clause,” (Article I, Section 7), of the U.S. Constitution.5

By the time the Supreme Court took the power away from him, Clinton had used the line-item veto to cut 82 items from 11 spending bills.6 While Congress overrode 38 of Clinton’s line-item vetoes, the Congressional Budget Office estimated the 44 line-item vetoes that stood saved the government almost $2 billion.6

Denied Power to Amend Legislation

The Constitution’s Presentment Clause cited by the Supreme Court spells out the basic legislative process by declaring that any bill, before being presented to the president for his signature, must have been passed by both the Senate and the House.

In using the line-item veto to delete individual measures, the president is actually amending bills, a legislative power granted exclusively to Congress by the Constitution, the Court ruled. In the Court’s majority opinion, Justice John Paul Stevens wrote: “There is no provision in the Constitution that authorizes the president to enact, to amend or to repeal statutes.”

The court also held that the line-item veto violated the principles of the separation of powers between the legislative, executive, and judicial branches of the federal government. In his concurring opinion, Justice Anthony M. Kennedy wrote that the “undeniable effects” of the line-item veto were to “enhance the President’s power to reward one group and punish another, to help one set of taxpayers and hurt another, to favor one State and ignore another.”

We the citizens of this country are not responsible for the financial problems of the individual sovereign states within this union in which we don’t reside. Those demonrat led states mentioned in this article are the result of their own corruption, mismanagement and fiscal irresponsibility… their financial woes likely existed for decades before this pandemic. The citizens of other sovereign states within the union of the United States should not be saddled with that burden.

I am willing to at least partially help these loser states if sufficient conditions are attached to the bailout. First, the states must repudiate most of their public pension plan payouts the same way Obama screwed CM/DELCO pensioners. Second they must end ego projects such as the California low speed train from nowhere to nowhere. Third they must cut public employee benefits to no more than the average corporate benefits package in the state. Third the Governor, Lt. Governor, and legislative bodies must resign with Federally appointed conservators replacing them with orders to do what it takes to cut government down to size within current taxation frameworks without increases.

Then I can see the bailout as accomplishing something good.

If you bail out one Democratic state that has been fiscally irresponsible at the expense of the other states that were fiscally responsible you will be setting a dangerous precedent. In some cases these fiscally irresponsible states have been paying pensions in the hundreds of thousands of dollars per year to retired teachers and firefighters who worked only 20 years.If you pay 1 irresponsible state then you will have to pay all of the states that mismanaged their public programs in some cases giving billions to illegal aliens. You will then be faced with bailing them out again since they will repeat this behavior and in another 5-10-15 years it will be an even bigger bail out needed.The states that were fiscally responsible will have to pay for states that spent like drunken sailors and that will create a civil war.

Every single state that is in impending Bankruptcy is a high tax Demoncrat [est.2012] run state.

We’re very soon going to be faced with these same political jurisdictions being forced into Bankruptcy, all because of their spendthrift ways over several decades. The Federal Government will have little choice but to backstop most of the debt involved, but it needs to have strings the size of mooring ropes attached.

What needs to be required:
Illinois is even closer to bankruptcy than California, which is barely ahead of New York in the race to the Bankruptcy Courts, something I have written about elsewhere.
They are now running to the Federal Government for a bailout, something I am opposed to but if it happens it needs to be under the following terms:
First, the entire state budget and all state funds need to be placed under a Federally Appointed CZAR, equivalent to the Court Appointed Receiver in a bankruptcy proceeding, who has plenipotentiary powers regarding all financial matters.

Second, during the period when the state is under the management of the Czar it shall be recognized by the Federal Government as a Territorial Possession of The United States for all matters dealing with the Federal Government but shall still be accorded the identifying title of “State of [fill in the blank]”. This means that the state looses all voting representation in The Congress and all Electoral Votes until it is restored to full responsibility for its own financial affairs, just like every other Territory. It may also loose access to certain federal programs that are intended for the various states but not for territorial possessions.

Third, all arrearages to any Pension Fund or any other fund that the state is a contributor to shall be brought current, using only state level funding sources, and maintained in that state for a period of one year and a day before financial control shall be restored to the state.

Fourth, the state must demonstrate ~full compliance~ with ~all~ Federal Statutes, Rules, Regulations, and Orders for a year and a day minimum, concurrent with all other requirements.


Fifth, the state shall be bound to all of the above terms until the Czar certifies in writing that the state has fulfilled all requirements, that its financial affairs are in order, and the Czar has concluded all oversight.

The above requirements are not subject to modification or stay by any Inferior Court but may only be modified by a 3/5ths majority of the Justices of The Supreme Court of The United States of America

Any breach of the above shall result in the State of [fill in the blank] being reduced to the status of a Territorial Possession and the Duly Appointed/Elected Territorial Government must make reapplication for Statehood under the then existing terms and conditions, as specified by The Congress of The United States of America and The Executive Branch.

The Demoncrats will never agree to these terms unless they are placed in a position of having their backs against the wall by the threat of Federal Prosecution for their Malfeasance in Office. They have perpetrated these acts of malfeasance for decades, and the bill has now come due and payable.
