Manhattan DA Declines to Prosecute Anti-Semitic Attack as Hate Crime

Decision angers legal advocates, Jewish community officials

The Manhattan district attorney’s office has declined to prosecute a recent anti-Semitic attack on a Jewish subway passenger as a hate crime, according to lawyers representing the victim.

Lihi Aharon, an Israeli student riding the New York City subway in December, was attacked by another passenger who cursed at her and yelled “Allahu akbar!” While the attack on Aharon seemed to be motivated by anti-Semitic animus, the Manhattan DA informed lawyers representing Aharon on Thursday that it would not prosecute the case as a hate crime.

The incident is one of several recent anti-Semitic attacks around New York City that have sparked a nationwide conversation about the resurgence of anti-Semitism in America.

“The DA’s refusal to prosecute this targeted attack as a hate crime is an egregious miscarriage of justice,” Brooke Goldstein, executive director of the Lawfare Project, which is representing Aharon, said in a statement provided to the Washington Free Beacon.

“The Jewish community is under siege and the DA’s office won’t even attempt to defend us,” Goldstein said. “Allowing acts of hate and violence like what happened to Lihi to go unanswered seeds the ground for more horrible tragedies like we saw in Jersey City and Monsey. We must send a message that religious bigotry and violence targeted against any minority community is not acceptable.”

Aharon and a Jewish man she was riding with were attacked after another passenger heard them conversing in Hebrew and saw the man was wearing a yarmulke, according to the victim.

“As soon as I sat, that woman started cursing and yelling at him about him being a Jew and ‘Allahu akbar’ and how Allah will end us all,” Aharon said in a video she posted online following the attack

“The Jewish community is under siege and the DA’s office won’t even attempt to defend us,” Goldstein said. “Allowing acts of hate and violence like what happened to Lihi to go unanswered seeds the ground for more horrible tragedies like we saw in Jersey City and Monsey. We must send a message that religious bigotry and violence targeted against any minority community is not acceptable.”

Aharon and a Jewish man she was riding with were attacked after another passenger heard them conversing in Hebrew and saw the man was wearing a yarmulke, according to the victim.

“As soon as I sat, that woman started cursing and yelling at him about him being a Jew and ‘Allahu akbar’ and how Allah will end us all,” Aharon said in a video she posted online following the attack.

The Manhattan DA decided not to prosecute the attack as a hate crime, or to present the case to a grand jury to decide whether it meets the legal threshold for a hate crime.

Aharon expressed surprise about the decision, particularly in light of similar attacks in the city.

“I was physically attacked and verbally assaulted for being a Jew,” Aharon said in a statement provided to the Free Beacon. “I was called a ‘nasty Jew.’ I was assaulted. And I am one of the lucky ones. So many people in my position, who have faced Jew hatred and anti-Semitic violence, have suffered far worse than I have.”

“Other victims of this same hatred and ignorance have literally been murdered in this city in recent weeks,” she said. “I am not willing to stand aside to make way for the next attack on members of my community. My assailant made it clear that she hated me because of my faith. I will not stop fighting for justice for myself and for the many people like me who have suffered at the receiving end of anti-Jewish violence.”

The DA’s decision to decline hate crime prosecution in Aharon’s case comes after five Jewish people were stabbed last weekend by an assailant who had a history of researching anti-Semitic agitprop. Prosecutors in that case have filed hate crime charges.

Aharon’s lawyers argued in meetings with the Manhattan DA that the case represents a clear example of a hate crime.

Ken Belkin of the Spodek Law Group, who also is working on the case, said the DA’s decision to not even allow a grand jury to hear the facts is baffling.

“The Manhattan DA’s office is refusing to view this clearly anti-Semitic attack for what it was, an obvious hate crime,” Spodek said. “Bafflingly, the DA is not even willing to present the case to a grand jury to determine whether it meets the criteria. Lihi was attacked after speaking Hebrew, conversing with a visibly Jewish man, and enduring anti-Semitic epithets hurled in her direction by the assailant. And it was all captured on video. If this isn’t clear evidence of a hate crime, I don’t know what is. This is a slap in the face to every Jewish New Yorker.”

You have to be careful in Latin America as well. Lots of anti-Semitism from Arab/Muslim refugees and immigrants over the years. Not to mention the existing anti-Semitism among latino’s. Social media allows the haters down there to spread anti-Israel and anti-Jewish propaganda. Sad

I am looking to split my time on the East Coast and Israel to make it easier to run my business. I tried running it from Israel for a month and the 10 hour time difference makes it hard to have a normal life and not feel exhausted all the time.

This failure to prosecute is clearly the wrong step. I have long urged my state AG to consider and prosecute those out there who speak hate that promotes violence, the kind of speech that was never intended to be protected by our Free Speech Constitutional protection. I firmly believe that if our legal system starts the process of prosecution of these haters, we will be sending a clear message that this country will no longer put up with this unmitigated hate against anyone. Even if the prosecutors face the First Amendment defense, I would urge them to take these people to court before their conduct generates a civil battle between the diverse groups within this country. The crazies out there might rein in their hate, rather than face the costs, time lost, incarceration that would flow from their violent hate tendencies. Write to your AG’s and DA’s and demand they take such action now before it is too late.

The problem is with subjective “hate crimes” it leaves room for a crime to not be a “hate crime”.
Hate crimes are subjective and based on emotions. Do you really want crimes based on emotions and punishment based on emotions? Emotions are the last thing you should want justice to be based on in any form.

Are “hate crimes” really fair? Take the common scenario of a husband and wife where the husband murders his wife for money or to avoid getting a divorce and wants full custody of the kids and no money paid to her for support.. Is it FAIR to not charge the husband with a “hate crime”? Was it a love crime that he murdered his wife? Why is her life worth less than say that of a Muslim that was murdered by a white person or a black person that commits premeditated murder of another black person. Don’t you see the biased and ridiculous unfairness of that – “hate crimes”?. Also how do you measure and EMOTION for punishment? Has charging anyone with a “hate crime” stopped or curbed “hate”? Of course not!

Liberals will always rely on EMOTIONS and here we are letting them prosecute and punish based on subjective emotions and cheering it on. Why should one group or class of people be elevated over another? That;s what liberals used to do and now they have others supporting it. Now you have another tier to the “justice” system that is subjective – perceived emotions.. We are helping to destroy our justice system with all this subjective criteria. Lady Justice has a BLINDFOLD over her eyes because it shouldn’t depend on WHO is on trial. Justice used to be equally meted out to whoever was guilty of a crime and equally punished. The sales of justice were to balance that out.

We need to get back to this:
The blindfold of Lady Justice is symbolic. She is to be BLIND to a person’s race, sex, wealth, power or any other factor that could sway justice. It implies she will be OBJECTIVE and BLIND to differences and justice will be served without BIAS or PREJUDICE and in this case not based on EMOTIONS that are SUBJECTIVE and only protect a certain class of people.

Felix, you and I usually agree on most topics, but your reply to my commentary, to me, is playing with semantics. The “hate speech” that I was referring to was directed at the kind of speech that reasonable people would conclude is intended to promote or is preaching violence against others for which there is invariably no justification. As you know, free speech does not protect anyone who falsely creates a panic that results in injury to others. In the same sense, speech that promotes the kind of hate that would motivate others or the speaker to commit acts of violence would and should not be permitted. I respectfully believe that a jury of one’s peers could to a reasonable degree of probability , and beyond a reasonable doubt, conclude that the speech in issue was intended to cause harm to others, and is prosecutable, notwithstanding the defense of free speech. That is the scenario that I was speaking too.

I am not intentionally playing with semantics. Whether it is a “hate crime” or “hate speech”, each is judged by EMOTION. and that is dangerous to have SUBJECTIVE “justice”. We are destroying our justice system by using this as a standard. So if I was not clear, I hope this clears it up.

People say stuff all the time about causing harm to others. Unless they ACT on it, we have t be very careful how we handle that.

While I cannot dispute your reasoning, I believe that our legal system can sought out the differences that we are both talking about. Anger, without any follow up with violence is, as you state, not usually either a civil or criminal act, although under certain circumstances it could be seen as an “assault.” On the other hand, hateful belligerence that intends to promote violence against any others, from my perspective, is actionable and is not protected by our Constitution, and I believe that our legal system can charge the triers of the fact in an appropriate manner to narrow the possibilities of what you fear.

Most crimes are “hate crimes” that do NOT involve Muslims.
The last thing you want to rely on is emotions for part of the crime or punishment.
Rape by a non Muslims is also a “hate crime”, yet it is not considered a “hate crime”.
It’s wrong to punish more harshly for a protected group – that is not EQUAL JUSTICE! You must punish ALL by the same standards otherwise it is NOT equal justice. Is a rape by a non Muslim LESS wrong or deserve LESS punishment? You victimize the victim all over again with unequal justice. As you know, Hitler started out with a Jew,being a “hate crime” and look what happened to others? After awhile anyone that went against him had the same fate.

Put another way, having “hate crimes” and”hate punishment” implies one group has MORE RIGHTS than another group for the same crime. That is an INJUSTICE to victims of the same crime. “Equal justice” was just destroyed when for the same crime the punishment was not equal and biased for one group.

“Imposing preferential penalties endorses the concept of relative rights, which is of course a very dangerous, slippery slope. It implies that some victims have greater worth than others. The extra and arbitrary enforcement power mocks the principle of equal justice before the law. Why should the penalty for assault be different depending on race, sexual orientation, or membership in a particular group?

Hate crime laws are bad but so are laws and penalties that specifically protect civil service employees including cops. In NYC, the penalties for assaulting a civil service employee are more severe than assaulting an ordinary citizen. If you ride the subway in NYC and someone assaults you, the criminal, if convicted, will not rcv as severe a penalty as if they assaulted a transit employee. There are even signs in the subway warning criminals about assaulting transit workers. Apparently it makes more sense for a criminal to go after the fare-paying public.

I agree! No person should be immune when they break laws the rest of us have to obey!
The only exception I would make is when a law enforcement person, police FBI or some like that is murdered in the line of duty. Then I want MORE punishment because of their occupation to protect us. I don’t include a police clerk or someone like that – only people in law enforcement that literally risk their life everyday to keep law and order.

The entire designation of hate crime was intended to inflict more severe punishment to Whites who commit crimes against Blacks. It was racist Black Supremacy legislation! Jewish people: Have you ever been attacked or stung by wasps?. A good defense may be to carry a can of wasp spray. A can may be purchased in any major store for under $4.00. It is easy to use and squirts a stream about 20 feet. Should even a drop get in someones eye it will be very painful but no permanent damage will occur. and since you are merely carrying it for insect defense and did not plan to have a weapon at hand it is a very plausible reason.
