President Trump on Thursday accused former Secretary of State John Kerry of breaking the law by meeting with Iranian officials last year — and went so far as to say he should be prosecuted under the Logan act.

The Logan Act (1 Stat. 613, 18 U.S.C. § 953, enacted January 30, 1799) is a United States federal law that criminalizes negotiation by unauthorized persons with foreign governments having a dispute with the United States.

Trumps accuses former Secretary of State John Kerry of talking to Iran and ‘telling them what to do.’

President Trump on Thursday accused former Secretary of State John Kerry of breaking the law by meeting with Iranian officials last year — and went so far as to say he should be prosecuted under the Logan Act.

“You know John Kerry speaks to them a lot, and John Kerry tells them not to call. That’s a violation of the Logan Act, and frankly he should be prosecuted on that,” Trump told reporters at the White House.

“But my people don’t want to do anything, only the Democrats do that kind of stuff. If it were the opposite way, they’d prosecute him under the Logan Act,” he said.

Trump appears to be partially referring to a reported meeting between Kerry and Iranian Foreign Minister Javad Zarif at the beginning of 2018, part of what the Boston Globe called “an aggressive yet stealthy” mission to put pressure on the Trump administration to keep the Iran nuclear deal.

Such a push was unsuccessful as Trump would announce the U.S. withdrawal from the 2015 Joint Comprehensive Plan of Action (JCPoA) just a few months later.

But Trump has repeatedly accused Kerry of being in violation of the Logan Act, which prohibits private citizens from negotiating on behalf of the U.S. government without authorization. No one has ever been successfully prosecuted under the law, however.

In September, Kerry acknowledged meeting with Zarif “three or four times” since leaving office, admitting to discussing the scrapped nuclear deal, among other issues.

“What I have done is tried to elicit from him what Iran might be willing to do in order to change the dynamic in the Middle East for the better,” Kerry said on Hugh Hewitt’s radio show.

On Thursday, Trump indicated he believes the contact between Kerry and Tehran to be ongoing, accusing Kerry of having “many meetings and many phone calls and he’s telling them what to do — that is a total violation of the Logan Act.”

A spokesman for Kerry pushed back on Trump’s remarks, calling them “simply wrong, end of story.”

“He’s wrong about the facts, wrong about the law, and sadly he’s been wrong about how to use diplomacy to keep America safe. Secretary Kerry helped negotiate a nuclear agreement that worked to solve an intractable problem,” the spokesman said.

“The world supported it then and supports it still. We’d hope the President would focus on solving foreign policy problems for America instead of attacking his predecessors for theater.”

Trump’s remarks came as the administration imposed sanctions on Tehran’s steel, aluminum, copper and iron sectors this week, the latest pressure the administration is putting on Iran’s already fragile economy.

Iran, meanwhile, announced that it will keep excess uranium instead of selling it as required by the nuclear deal. It also issued an ultimatum to Europe that it will enrich its stockpile in 60 days unless new terms to the deal are negotiated.

He absolutely should be prosecuted. He more or less admitted to telling them to wait it out under Trump and how to circumvent Trump. while NOT working in a government capacity. It hasn’t been successfully prosecuted in the past but Kerry could change that. He did all he could to keep the Iran deal alive and lied while in position. Obama stealthily does the same thing. He shadows Trump where ever he goes to dissuade them from Trump’s agenda. I don’t think we would be successful in nailing Obama. Seeing Kerry go through the stress and anguish would be worth it. Some make their own money whereas Kerry had to MARRY for it – Heinz family. McShame married for it as well as Paul Ryan. We have allot of KEPT MALES by wealthy women in D.C..

Oh how many stupid, possibly evil and criminal acts have been committed under the “Doing it for the good”… Good of whom… The Iranian regime will never HONESTLY deal with Western Governments… They will lie and break deals left fight and centre…John Kerry will be the one with his mouth open wide in astonishment as Iran sends a long range Nuke towards USA, he’ll be saying “But they PROMISED they would never do that!”

Do politicians work for the people, or themselves ?? Jawn Kerry, who in his mind is better than us plain, mere mortals, has had several “Do you know who I am” moments throughout his political career. Two of interest I’d like to point out.

Kerry and his gazillionaire current wife own several multimillion dollar properties throughout the world. One is in the tony Boston neighborhood of Beacon Hill. Mrs Heinze-Kerry kept getting parking tickets for parking too close to a fire hydrant on the sidewalk in front of their home. So, Jawn Kerry made a few calls, asked them “Do you know who I am ?”, and days later the offending fire hydrant was literally moved down the block.

Jawn Kerry also had his multimillion dollar yacht docked in the neighboring state of Rhode Island. This was done of course to avoid paying taxes, which he had helped raise several times over back when he was a mere state politician. With the surrounding negative publicity, Jawn Kerry moved the boat back to Massachusetts. What was not publicized was whether Jawn Kerry actually paid those pesky back-taxes that he thinks only the “little people” have to pay.

Bring him up on the Logan Act charges, Mr President and Mr A G !!!!

the Logan Act,” he said. The last part about the fact that Democrats would gladly utilize the Logan Act to prosecute a Republican for this crime is true. I do take issue with Trump’s saying that his people don’t want to do that. Failure to punish this brazen act of sedition only encourages more of the same. A whole lot of members of the deep state cabal need to be locked up right now. There is more than enough evidence to provide big wins for the people of the US who are sick of the dual justice system.

Kerry clearly violated the Logan Act, by negotiating with a foreign government as though he was representing the U.S., which he wasn’t. He wasn’t in the government any longer, he was a civilian. Nor was Kerry asked to mediate the issue between the two governments. Further, he was encouraging negative actions by Iran as a response to President Trump’s withdrawal from the treaty as though it had already been approved by the Senate. He seemed to be working to oppose the actions of a sitting U.S. President. Citizens taking actions with a foreign government that in no way interfere with U.S. policy for that country may be OK, but what Kerry did was not OK, in fact it bordered on the traitorous. We can’t have civilians interfering with the U.S. foreign policy, and no one may have been prosecuted for Logan Act violations before, but no one has really violated it since Jane Fonda until now.
