This is one of the most appalling decisions to be issued by an American court since the Dred Scott decision. If the law that’s being used to prosecute her is unconstitutional, then is it even possible to criminalize FGM in the United States? This far-left, activist judge apparently has no concern whatsoever for the girls who are going to suffer intense pain and have their lives destroyed because of his ruling.
The number of women and girls at risk for female genital mutilation (FGM) in the United States has more than doubled in the past 10 years. More than half a million women and girls in the U.S. are at risk of undergoing FGM in the U.S. or abroad, or have already undergone the procedure, including 166,173 under the age of 18, according to the Population Reference Bureau (PRB).
This judge should be impeached and removed from the bench.

“Federal judge orders female genital mutilation charges dropped in Detroit,” WJBK, November 20, 2018:
DETROIT (WJBK) – A federal judge has dismissed six charges of female genital mutilation against a doctor, declaring the nation’s female genital mutilation law as unconstitutional.
The federal judge in Detroit ruled in the historic case on Tuesday, ruling the law that prevents female genital mutilation (FGM) is unconstitutional. U.S. District Judge Bernard Friedman ruled that congress does not have the authority to make FGM illegal, which it had been classified as illegal under the Necessary and Proper Clause or the Commerce Clause.
The case involved Dr. Jumana Nagarwala who had been awaiting trial on female genital mutilation charges. She was arrested in the summer of 2017 and was released on a $4.5 million bond.
According to the opinion filed by Friedman, congress had banned FGM under a statute that states “whoever knowingly circumcises, excises, or infibulates the whole or any part of the labia majora or labia minora or clitoris of another person who has not attained the age of 18 years shall be fined under this title or imprisoned not more than 5 years, or both.”
Prosecutors said she did that with at least six girls at a clinic in the Detroit area, including two girls from Minnesota. The doctor denies that she committed a crime and says she performed a religious custom from her Muslim sect, the India-based Dawoodi Bohra.
The doctor, through her attorneys, argued that the law that the federal government had been using to charge her was passed through Congress without proper vetting.
Her attorneys argued that the act of FGM had no bearing on commerce, which judge Friedman agreed with in his opinion:
“That clause permits Congress to regulate activity that is commercial or economic in nature and that substantially affects interstate commerce either directly or as part of an interstate market that has such an effect. The government has not shown that either prong is met.”…

FGM is ILLEGAL at the FEDERAL LEVEL.
This must be appealed and this judge impeached.
He is NOT following the clear rule of law.
HERE is the law that makes it ILLEGAL:
18 U.S. Code § 116 – Female genital mutilation
(a) Except as provided in subsection (b), whoever knowingly circumcises, excises, or infibulates the whole or any part of the labia majora or labia minora or clitoris of another person who has not attained the age of 18 years shall be fined under this title or imprisoned not more than 5 years, or both.
(b) A surgical operation is not a violation of this section if the operation is—
(1) necessary to the health of the person on whom it is performed, and is performed by a person licensed in the place of its performance as a medical practitioner; or
(2) performed on a person in labor or who has just given birth and is performed for medical purposes connected with that labor or birth by a person licensed in the place it is performed as a medical practitioner, midwife, or person in training to become such a practitioner or midwife.
(c) In applying subsection
(b)(1), NO account shall be taken of the effect on the person on whom the operation is to be performed of any BELIEF on the part of that person, or any other person, that the operation is required as a matter of custom or ritual.
(d) Whoever knowingly transports from the United States and its territories a person in foreign commerce for the purpose of conduct with regard to that person that would be a violation of subsection (a) if the conduct occurred within the United States, or attempts to do so, shall be fined under this title or imprisoned not more than 5 years, or both.

I just HAD to find out WHEN this ruling came out. The few dates I can see, on the last “sentence” of that article, don’t make sense to me. Am I thinking right?….there was a LAW on the books, about FGM??? Around those dates?? How can any high up official, even KNOW anything about FGM, back then?? Never mind, writing a law, for it!! I’m confused….can someone explain, or tell me, how long has FGM, been going on in THIS country!?? AND…IF it has been going on, all these years…then why is it, that ONE little case (when FGM, have been ON the books, for THAT long) would make headlines, and have everyone in an uproar??

“The amendments made by subsection (b) [enacting this section] shall take effect on the date that is 180 days after the date of the enactment of this Act [Sept. 30, 1996].”
Congressional Findings
Pub. L. 104–208, div. C, title VI, § 645(a), Sept. 30, 1996, 110 Stat. 3009–708, provided that:
“The Congress finds that—
“(1) the practice of female genital mutilation is carried out by members of certain cultural and religious groups within the United States;
“(2) the practice of female genital mutilation often results in the occurrence of physical and psychological health effects that harm the women involved;
“(3) such mutilation infringes upon the guarantees of rights secured by Federal and State law, both statutory and CONSTITUTIONAL;
“(4) the unique circumstances surrounding the practice of female genital mutilation place it BEYOND THE ABILITY OF ANY STATE OR LOCAL JURISDICTION TO CONTROL.
“(5) the practice of female genital mutilation CAN BE PROHIBITED without abridging the exercise of any rights guaranteed under the first amendment to the Constitution or under any other law; and
“(6) Congress has the affirmative power under section 8 of article I, the necessary and proper clause, section 5 of the fourteenth Amendment, as well as under the treaty clause, to the Constitution to ENACT such legislation.”

That is the law the court overturned, correctly, as not being within Congress’s powers.
But every state bans child abuse, and FGM is certainly that.

This is an excerpt from the book Infidel (page 32) that describes Ayaan’s FGM experience:
“Then the scissors went down between my legs and the man cut off
my inner labia and clitoris. I heard it, like a butcher snipping the fat
off a piece of meat. A piercing pain shot up between my legs,
indescribable, and I howled. Then came the sewing: the long, blunt
needle clumsily pushed into my bleeding outer labia…When the sewing was finished, the man cut the thread off with his teeth.”
She cannot experience sexual arousal for the rest of her life. The ‘recovery’ period after FGM is even more hideous than the operation itself.

I agree with you, but the majority of these girls when they have children will insist that their daughters undergo the same appalling procedure. The cycle will never end and in the UK this has been going on for years, although it is a criminal offence, no one has ever been charged and now this has happened in the US.

Americans have already been killed, around this country, from these “people”, hands, and until Trump has eyes, back on THIS country, the killings will continue. 17 years in Afghanistan hasn’t made THAT country, great again, even with the billions? trillions? thrown at it! And we got islam being taught in many schools across this nation, to our young children. With each article, of THAT, I wonder why I’ve never heard from the Secretary of Education (surely Trump picked one?)
Anyway, get ready to be a third world craphole country! Nothing at all can be done, when we hear news like this FGM. We could protest, write our senators, etc etc….see how well THAT works out! Devos is a waste of time. She is out Secretary of Education. Let’s put it this way, Jeb Bush is a huge fan of Common Core and he was elated when Trump picked her. She has done NOTHING to change Common Core. It’s still in place and she recently hired another Common Core pal to continue with it. Rebranding Common Core doesn’t change it. Devos has to be gotten out.

So I could look this “Devos” up, but I’m kinda swamped, with catching up with the news for today, but do you happen to know how this Devos Secretary of Ed., feels about islam? Very curious of that. And if she does support muslims here, why would Trump pick her? (Of course, HE supports muslims, and islam in this country anyway.) Wonder what qualities she has, that got her picked for the job…
I’m going to look her up, to find out more about her, when I have a little more time, but is there anything else, that you know about her? I don’t know a single thing, except she’s allowing islam to be taught in many schools across this nation, and that’s plenty maddening enough…to me.
And yeah, as for common core, THAT used to be talked about in a lot of my newsletters, but seemed to have dropped off to non-existent, in the news, for quite a long time now. But still happening, huh? Dang, very sad to hear. The only rational reason we were ever in Afghanistan was to capture or kill Bin Laden, and that is done. We should GTFO if for no other reason than that being there makes us beholden to Pakistan to be able to supply those troops or get them out.

Wow, Achmed, you know your history. Do you have a site, where we can read about that, and more? I never cared for history that much..at least, not until…the invasion came. Since 9/11, I’ve lost a lot of sleep, and sometimes forget to eat, with the learning I’ve been doing, since then. As the saying goes, “I’m on it, like ? white on rice?”. Not sure if I got that right, but you get the meaning. I spend hours on it, and there’s not much, I don’t know about it now. I’ve even thought about finding some time, to learn the language! I also feel like I know how all of this “immigration” fits into bible prophecy, which I feel, I’m very knowledgeble about that!
So thanks for giving us some history on it, and where can we go, to learn more?

A peaceful and blessed Thanksgiving to you and yours as well. How Alexander’s forces conquered such vast lands is one question and, I’m certain, can be easily explained. However, how he left enough forces behind to rule …that’s the difficult thing to grasp. For example, in Afghannyland, he originally left some of his very loyal Ionian officers. They ruled for a while, but another group of Alexander’s Greeks overthrew them and ruled for over three hundred years.

17 years, we’ve been in there, our young men are getting killed or wounded (for what?), and trillions of dollars thrown at that country, and that country isn’t “great again”?? Makes me wonder, how long before the US, is “great again”. I’m not wearing a MAGA hat, until I see proof of that, OR holding my breath…but hey, let’s look at the good side…unemployment’s down, economy is up…but some sites are saying, none of those are true. In the The Guardian and Accidental Pictures’ feature documentary, the women interviewed admit to being uneducated so they can’t read They are under the impression that it is in the Quran and pleases Allah. It is abridged version of the documentary. As it turns out it may not be in the Quran and it is simply a sadistic tradition that is part of their culture Yet, an IMAM did ban it as well as child bride marriage. It’s fuzzy on whether or not FGM is in the Quran but child bride approval IS in the Quran. Islam is a totally made up religion. It’s a sadistic imitation of Judaism and Christianity.

Looking at first glance, through that, my first thoughts were….OMG! And I believe those numbers, but I’m speechless with shock.
I gotta add something to my first request though (that I left out). We need to see url’s of where you get your info from. Or if someone doesn’t know what a URL is, then just give the name of the site, and the title of the article. Pew Research pegged the number of moslems, in the US, between 3.2 Million and 3.6 Million. That puts ’em at around 1% of the population. For 1%, they surely get some extra special dispensation.
More than likely the “rising of the moon” has to deal with when the moslems start their daily gorging. The average moslem gains close to 3% body fat/weight during roomeeding … as they gorge themselves from sundown to sunrise. Not much of a “fast” is it?

Many boys today – and some girls – are experiencing an equivalent of that “freedom” via extremely harmful, dangerous and irreversible “reassignment surgery” meant to lock them into the “transgender” lifestyle for life. And many who underwent that never really recovered, and in some cases committed suicide.
This trend of transgenderizing society may be part of why male fertility rates have been falling to alarming levels, other factors being abortion on demand and the Left’s long-standing war on males of which the #MeToo movement is one of the latest manifestations.

Somewhere I read that around half the people that had these “procedures” went on to commit suicide. That alone should raise red flags, but if anything it seems to encourage the practice.

Let’s look at everything, the BIG picture. FGM, to me, is just one piece of the horror, that this country is going through. All you have to do, is to look up, how many muslims are in THIS country, and the killings they have done (I have all THEM, archived too, from here, in the US, and around the world), and that FGM case would look like a tiny piece of dust, compared to the other horrors, and the horror, that’s still coming.
Would Trump talk about this FGM situation, at some point in time, now or later on? I laugh at myself, asking THAT question, because we’re talking about a president, that wished all muslims “best wishes”, while he hosted a Ramadan dinner, in our White House! (and yes, Obummer did it too.) Now, any “true” christian, would know, that you do NOT celebrate another god’s holiday…and we are also told, to “know them, by their fruit”.
Let’s wait for Trump to say something about this FGM case…or help that christian lady in Pakistan, that has made headlines everyone, and could use our help. I’m not holding by breath, on either one.

I always felt that the prosecution was going about this incorrectly. They need to straighten it out as to whether she performed a legitimate medical procedure that requires medical/surgical license or if she performed a religious rite, which does not require a medical license.
If the claim that this was a religious rite then where is her license to perform such a rite? Moyles must be licensed to perform circumcision.
If it is claimed to be a medical procedure then what disease state was being treated? If the disease state is “normal female genitalia” then the doctor’s medical license should be revoked on ethical grounds. Even if she is getting away with this particular case her license should be revoked to protect the rest of the public.

FGM can not be compared to male circumcision . This is trying to compare apples to steak. There is absolutely NO benefit to FGM. Female genital MUTILATION removes any sensation and follows with psychological problems, health problems for life and possible death. Have sex after FGM is painful and the same as being raped. A female body no longer has the ability ti prepare for intimacy since all sensation is removed. Male circumcision offers better hygiene, increased sexual sensitivity and because of better hygiene adds protection against STDs etc. FGM offers NONE of this. You can not conflate the two!

So, let me get this straight….one couple up north let their two young kids walk to the park near their home….alone. Their kids were taken from them by child protection services…to get them back they pretty much had to give up their parenting rights…..

As Michael Savage has succinctly put it over the years, “The stench from the bench is making me clench.” This decision, though outrageous and wrong-headed as it is, is at one with a series of decisions from the judicial tyranny such as one made in Ohio last year where the parents of a teenaged girl were stripped of any and all custody after that girl – no doubt unduly influenced by LGBT proselytizers in her school, propaganda in regular and social media, and so on – decided she was a boy and opted to commit to F-to-M reassignment surgery, and the parents had objected strenuously. If all these cases (including this latest) do not show that our leftist elites (or those all over the West) could not care less about women or children and are in total service to ideologies that by their very nature are supremacist, I do not know what does.

I feel certain that FGM, including this case, can be prosecuted under existing laws against child abuse in every state in the US. It’s so obviously an intentional injury that nobody would believe it is “medical treatment.” Ironically, the court even said so itself, which is one of the reasons it had to throw out the federal law: If it’s not an act of commerce, it can’t be interstate commerce.
So relax. This criminal won’t go free, he will just be retried under state law, as he should have been in the first place.
