But Twitter can block, silence and censor any other American they want to? This ruling is absurd. Remember: Jack Dorsey, the chief executive at Twitter, gave a thumbs-up to an article penned by a leftist techie, Peter Leyden, calling for the extermination of the Republican Party. Twitter is notorious for banning and shadowbanning voices that dissent from the left’s agenda. Meanwhile, jihadis and violent Antifa thugs have free rein. This new ruling raises some important questions. If Trump’s blocking people violates the First Amendment, will Leftist politicians such as Keith Ellison and others who are active on Twitter also have to unblock people? Probably not. These kinds of rulings only apply to conservatives.

A FEDERAL judge in New York has ruled that US President Donald Trump may not legally block Twitter users because doing so violates their right to free speech under the First Amendment of the Constitution.

The ruling by US District Judge Naomi Reice Buchwald in Manhattan came in response to a lawsuit filed against Mr Trump in July by the Knight First Amendment Institute at Columbia University and several Twitter users.

Judge Buchwald agreed with the plaintiffs’ contention that the discussions arising from Mr Trump’s tweets should be considered a public forum. She rejected an argument made by Justice Department lawyers that Trump’s own First Amendment rights allowed him to block people with whom he did not wish to interact. Trump was a prolific tweeter from his @RealDonaldTrump account even before being elected in 2016 and has since made it an integral and controversial part of his presidency.

Aides reportedly have tried to rein in his tweeting, which often starts early in the morning. But he has remained unfettered and uses Twitter to promote his agenda, announce policy and attack critics, especially the media, and the investigation into possible Russian connections with his campaign.

A spokesman for the US Department of Justice, which represents the president in the case, had no immediate comment. Twitter also did not immediately comment.

The Knight Institute and the individual Twitter users claimed in their lawsuit that by blocking users for their views, Mr Trump was shutting them out of discussion in a public forum, violating the First Amendment….

This ruling can have some interesting unintended consequences, especially those who have been blocked from websites. The long term consequences may be detrimental to the Internet and website owners.

What the Judge got wrong is there are numerous sites on which to go to state your opinion.But I know she claims that the “Presidential communications” laws apply,she is incorrect.

If he was running a government-run service or app, then it shouldn’t be blocked. If somebody objects to what he says, there are other avenues to do so. But he is using non-government Twitter. Block away.

Time for We, the People, to demand, repeat, DEMAND!, the impeachment of these fascist revolutionaries posing as federal judges. Our judiciary has been corrupted and legislating from the bench is the rule, not the exception. This MUST be stopped.

HOPEFULLY THE PRESIDENTIAL DISTINCTION WON’T STAND CHALLENGE AND Only if Trump appeals will it be decided by SCOTUS, otherwise it is final with this court. I hope Trump doesn’t appeal and allows this ruling to become final because her attempt to provide a narrow distinction that just affects the President’s use should be easy to challenge . Many cases have had a much broader effect than the erroneously narrow distinction intended by the ruling judge. The Constitution doesn’t provide more or less rights for the President. She ruled his use is a PUBLIC FORUM but isn’t all of it, and as Sen. Cruz has been arguing, either the Congressional decision that gave social media an exemption from defamation liability based on a law protecting PUBLIC FORUMS should be reversed, or they are a public forum, which door this case opens. The social media would face serious problems if they didn’t have that exemption. What’s more important? the President’s blocking rights based on every user’s contractual agreement with Twitter that one can block other users or that it is a Public Forum and no one can be blocked,which would include Twitter… and Facebook, YouTube etc..This is the game that they have been playing…they are a private biz (not subject to 1st Amendment Rights) controlled by contractual rights when it helps them but a public forum when it benefits them.

Those in politics and the media who seek to hamper the First Amendment freedoms of others need to be reminded that those are the very same constitutional liberties that make political discourse and a free media to even exist in the first place.

Having seen some of the contemptuous and irreverent tweets directed at the President, I’m surprised Secret Service isn’t paying these jackwads a visit. Not all speech is protected and death threats, however veiled, fall into that category.

Really? Any of us can block people on any story…..but the President of the US can’t?! I’ve never used Twitter or FaceBook. So glad I never got sucked into that.
How are we going to get rid of these Lefty Judges?
The President ought to have his IT people create his own blog site and the terms of use can be that he can block anyone he wants……I’d join that site.

Reluctantly I have to agree with the Judge. The President has , apparently, used the Twitter account to conduct government business thereby making it a government function subject to the First Amendment. By blocking access to the Twitter account he is effectively censoring the Twitter accounts as a government entity. If he had not used the Twitter account for government business the Judge would be wrong. I am NOT an Attorney. This is my personal opinion only and should NOT be construed, taken or relied on as legal advice.
