Sex with 10 year-old not rape, Finnish court rules in migrant’s case

In a case that has triggered public outrage, a top Finnish court has upheld a ruling that sex between an asylum seeker and a 10-year-old girl didn’t constitute rape. Critics are calling for harsher sentences for child abuse.
Finland’s Supreme Court rejected a request from the prosecution to appeal a three-year jail term for a 23-year-old man on Thursday. Finnish media identify him as Juusuf Muhamed Abbudin, an asylum seeker, but don’t reveal his country of origin.
The man was convicted of aggravated sexual abuse, although the prosecution had sought a harsher sentence on charges of aggravated rape. However, the court left the original verdict unchanged.
The incident took place near the city of Tampere in southern Pirkanmaa region in autumn 2016. The man had sexual intercourse with a girl, who was 10-years old at the time, in the yard of a deserted apartment block. He also exchanged sexually charged messages with her.
Both Pirkanmaa District Court and the Appeal Court in the city of Turku convicted the asylum seeker of aggravated sexual abuse and handed him a three-year prison sentence in 2017. The courts didn’t recognize the incident as rape, saying the girl wasn’t forced into the sexual act or overcome by fear. The judges also ordered the man to pay the child €3,000 ($3,600).
The decision fueled fierce debates across the country. Tuula Tamminen, professor of Child Psychiatry at the University of Tampere, insisted that the child simply couldn’t know what was happening in such a situation.
Back in November 2017, National Coalition Party MP Kari Tolvanen spoke in favor of longer sentences for such offences. “The amendment would introduce harsher sentences for serious sexual offences against children overall. In my view, that is fully justified, for example in light of a child’s vulnerability, even if the act does not meet the threshold for rape,” Tolvanen said.
In March, Finland’s Justice Minister Antti Hakkanen also called for tougher laws for sexual offences committed against minors. “Children should be protected from violence and sexual assault by all available means,” the minister stated. “I asked officials for proposals on toughening the law on sex crimes. I regard these proposals as viable and I intend to advance them.”

We need (the Finnish people need) a class action lawsuit against the Supreme Court in this case, to force the SC to uphold Finnish law in regard to child rape aka “statutory rape,” which must be enforced against the rapist even when the rape is described as being purportedly “consensual” or “allowed” by the minor preteen girl. Yes, it may be “consensual” and therefore AOK if the girl was an adult woman of “consenting” age. BUT this is not true in this case, she’s ten years old, so “consent” has no validity here. How much more obvious can this be? Has Finland lost its mind? This is not just one case we are talking about. This is opening the floodgates for moslems to pour into Finland, seeking out little girls to get to consent to rape. And of course it will also lead to NONCONSENSUAL rape of little girls as well, and arguments that little girls have consented when in fact they have not, and the argument then will be that the little girl is fantasizing and making up stories about her not consenting, and blah blah blah. This SC decision must be destroyed by any means necessary such as a lawsuit or actual imprisonment of the judges involved, fines paid, something. This cannot be allowed to stand. This makes no sense whatsoever. I’m assuming the statutory rapes occurred outside of Finland…that would be the only way a judge could guide a jury to such a verdict. The sad thing is that political correctness prevents us from educating these people once they immigrate. Plus they set up their own Islamic schools which make it harder for us.

A ten year old girl is in FOURTH GRADE to put more perspective on this. ELEMENTARY SCHOOL! This really burns me up! LEAVE THE KIDS ALONE.
Physically they may heal but PSYCHOLOGICALLY it is another story. No little girl should EVER have to endure this or be victimized again in court like this. This is beyond shameful. BTW Muslims like raping INFANTS too!

Eventually, people will start taking matters into their own hands. When the State fails in its duties and does not meet the expectations of the community, the State loses authority.
I can guarantee, if someone raped a 10 year old girl I was related to and got off scot free – I’d hunt them down disable them and castrate them.
We’d never see another rape committed by that creature again. Kind of hard to do it, when you’re missing your genitals – and for good measure, your right hand and left foot. Can’t chase your victims, can’t grab them and can’t do anything about it even if you do manage to corner another little kid.

Yes, and the West need not deal with these aliens at all by merely not allowing their immigration. A homogeneous population of Finns know, and agree, that sex between a grown man and a 10 year-old girl is wrong and illegal. It is part of their common culture and community trust. Now welcome in a radically different population of aliens who have entirely different cultural and religious beliefs and you’ve got a recipe for disaster.

Of course they were “fearful” and biased that the Defendant was Muslim, and the root problem is immigration from incompatible cultures…BUT. the laws in Finland, as indicated in the article, are not as strict on any violators involving children this age, compared to American standards, and that is traditional for them, and should be more clearly defined as the article covered. The fact that it was the high court’s decision to go easy was probably political, although the immigration problem and compatibility topic is at least receiving public debate, unlike Sweden.

My best guess, as someone who has been to Finland and as a follower of news about the country, is that Finland has for so long sustained a low crime rate that authorities must have been stunned by this inexcusable crime. Moreover, prosecutors, having little experience with crimes, outside of those usually alcohol related, probably were hesitant to go for the max. This attitude must have gone up as far as their top court. There is no doubt in my mind that ordinary Finns are revulsed by this ruling.
