Mind you, this devout criminal can adhere to his Islamic diet in prison. This savage was told that his food would not come into contact with pork or alcohol, halal requirements. Muslim rapist sues state for not providing halal meals in jail

Editor’s Note: As you read the story below, remember these types of legal actions are being filed all over the country as the Council on American Islamic Relations and other Muslim Brotherhood-backed groups aggressively wage civilizational jihad against the U.S., just as they have done in Europe. I don’t think our Founding fathers ever imagined the First Amendment would be used this way, and I doubt my Catholic great-grandparents would have, in their wildest imaginations, thought of filing these types of suits against schools, jails, employers, etc. after they emigrated to America in the early 1900s.
An inmate has sued the Oregon Department of Corrections staff for failing to serve halal meals in accordance with his Muslim faith.
Rashid Kambarov, 29, who is serving an eight-year sentence for rape, filed a complaint this week in U.S. District Court in Pendleton.
The Turkish migrant is not a U.S. citizen but is living in the United States legally on a green card. He is currently incarcerated at Two Rivers Correctional Institution in Umatilla and is suing the superintendent along with other administrators at the prison, the Oregonian reports.
Betty Bernt, spokeswoman for the Department of Corrections, said the agency accommodates inmates’ requests for religious diets by offering a “meat alternative tray” or a kosher diet prepared in accordance with Jewish law.
Kambarov alleges he is not served halal meat and that vegetarian alternatives have been cross-contaminated with pork. Halal refers to food and drink prepared in accordance with Islamic dietary laws, including beef and chicken that is ritualistically slaughtered in the presence of an imam.
He claims the state’s failure to accommodate his religion violates the First and 14th Amendments and the Religious Land Use and Institutionalized Person Act of 2000, which bars state and local jails and prisons from imposing arbitrary limits on inmates’ religious practices.
According to the suit, Kambarov asked for and was denied a special diet to accommodate his faith when he was sent to prison in 2015 for raping and sodomizing a 31-year woman who he cornered at a Portland motel.
He says he was told the department offers Muslim inmates a “pork-free meat alternative diet” that includes fresh and cooked fruits and vegetables.
He says he was told the food would not come into contact with pork or alcohol, halal requirements.
Kambarov said he was also told the vegetarian option “is the best option for a Muslim.” However, Kambarov said he witnessed kitchen staff handling vegetarian meals as well as salami. He said he watched staff use the same knife to cut vegetables and ham.
He said his requests for kosher meals, which are prepared in accordance with Jewish law, were rejected by prison staff. Kosher requirements satisfy Muslim dietary restrictions, he said.

No cake. Give them pork or blandest veg options. And ban koran and group koran readings/Preachings to muslims. They can do it in their dank cells alone.
It should serve a message to all future muslim criminals. Jail is worst place to be as you won;t get halal meat ! watch as the number of jihadi attacks reduce.

I am in agreement with that vile moslem. No one should be imposing arbitrary limits on its religious practices. Feed that thing meals that are all either pork, or fried in pork renderings. However, under NO circumstances should it be forced to eat it .. that would be placing a limit on its religious practices.

Being able to sue the state because of THIS is a failure in the judicial system. He should simply be reminded of the fact that he is a prisoner and not a hotel guest and therefore has absolutely no right to express any kind of extra wishes. Not concerning the food and not anything else. You don´t want pork? Well, then starve! You would see how he would start eating it as soon as the real hunger kicks in…

THIS guy can’t vote, because he is not a citizen.
And there is every chance he will be deported, when his prison term is up, due to his crime.
I’m a Democrat, and I’m okay with that. It’s one of the natural consequences of his crime, and there are many.
But we still need to treat prisoners like human beings. Otherwise our system is not one of freedom and justice, but is no better than a legal system that beheads blasphemers, stones adulteresses, and whips women who appear in public without a veil. And believe me, the Caliphate would be more than happy to tout OUR brutality in their propaganda videos. I can’t believe all you people here are seriously suggesting the US adopt such policies.

As for voting. Yes he can vote. All he needs is a Driver’s License. The fact that it is illegal is as important as the price of rice in China during the Ming dynasty. But voting is irrelevant – the real cheating is in the representation – and when he is released he will be counted as a Democrat.
Didn’t they teach you anything in Con-Law? Or did you just learn that the COTUS was an invention of the Evil Whitey to oppress the Non-White Uber Humans???
As for deportation – that’s meaningless unless he goes to college and becomes a scientist or an engineer – assuming the system remains unchanged. As a criminal all he has to do is talk to his buds and arrange for a return to a Sanctuary City/State. Of course, if he gets all reformed, he might not be allowed to return. Because that’s exactly how our system works.

Well, I myself only wrote a short and to-the-point comment, and clearly the only “venting” here is by our friendly local Democrat, Mr. Jacobs.
Still, I invited this puffery, when I wrote “”Ask any Democrat” – and sure enough, a Democrat has appeared, spouting the usual boilerplate.
Surely, Mr. Jacobs is aware of numerous studies that demonstrate illegals do in fact vote in our elections.
If so, he would likely discount those studies; but even he would have to admit, perhaps, that Democrat efforts to lift voter I.D. requirements – and to restore voting rights to felons plays a part in a real problem.

As for deportation, one must suspend all knowledge of “sanctuary cities” to suggest that the deportation of convicted criminals is inevitable.
More to the point, Justice, not “freedom and justice” is the foundation of the penal system: the dispensation of justice requires the removal of freedom from the convicted.
The comment about treating prisoners as “human beings” is obviously an attempt to introduce a strawman, and the writer continues in this vein: “I can’t believe all you people here are seriously suggesting the US adopt such policies” e.g. beheading, stoning, whipping etc.
I haven’t found a comment that suggests any of this, which begs the question – is this a product of a fevered imagination?
Finally, it is asserted that it somehow follows that intolerance of Islam makes the intolerant “worthy of defeat and slaughter.”
As gentle a reproach as I can muster to this ugly inversion of decency is to refer the writer to Isaiah 5:20.
Finally, Mr. Jacobs worries about “recruitment.”
I would refer him to a study of the Beslan massacre, and the Russian response.

If we deny prisoners ANY human or civil rights at all, how is the US prison system any different than a Soviet-era gulag? Think about it. The US Constitution prevents us from failing to treat prisoners like human beings, regardless of how severe their crime was. Laws like that protect us all. Or, do you want EVERY hapless citizen who gets thrown in jail for some small crime, to be subjected to the same brutal torture? Brutal jailers would not care if you were a murderer, or a jaywalker, or a litterbug. They would beat the crap out of you, and feed you scum, regardless.
Do we really want to live in a society that tolerates that? I don’t.

We already live in a society where US citizens are second class – and that’s if they are a Protected Class. If you’re not a Protected Class, you ain’t Jack Squat.
Conflating access to Halal food – and the right to frivolous lawsuits to harass the prison system – with TORTURE – is Beyond Superlatives. I have had many friends who SURVIVED real torture, and had the scars and testimony to prove it – and none of it was comparable to being fed bacon.
As for tolerating out of control prisons – apparently you are perfectly happy with prisons where the most violent and dangerous inmates and gangs can – and DO – beat the crap out of prisoners, steal their stuff, rape them, and even kill them. Because that’s exactly what we are discussing.
Do you really want the dysfunctional prison system that churns out more killers and criminals to continue, or do you want an actually progressive system that sorts prisoners according to their problems – and helps them to overcome those problems?
Hating a prison system trying to reform itself equals loving a prison system that will never reform.

Allow his victim to sue him for the damages that could have started with him violating her. Ignorance of the law is no excuse, he should have known that getting jailed, would result in him losing the freedom those not in jail have. If he doesn’t want to eat the same as every other prisoner, he should have behaved in such a manner as to stay out of jail.

I’m sorry this is news to you, but crime victims DO already have the right to file civil suits against criminals who caused them harm or injury. Do you remember OJ Simpson? Even though he walked free (due to jury nullification, essentially) from the criminal charges for the dual murders he committed, he was successfully sued by his victims’ families who won a huge civil verdict against him. Does that ring a bell?
Collecting on such a judgment is an entirely different matter, however. Even a rich guy like OJ has been able to avoid much of the collection efforts by his victims’ claims against his assets. And, even if the rape victim obtained a huge judgment against this rapist, there’s a good chance he’s a penniless dreg of society without a pot to piss in, so it wouldn’t do much good in terms of putting money into the victim’s pocket. Which is why many, nay most, lawyers would not pursue such a suit unless it IS against a rich guy — intentional crimes are not covered by insurance, like a car crash would be, so if a defendant is poor, the chances of collecting money for the harm he caused is near-zero.
Some states provide a “victim compensation fund” for situations like this, paid by tax dollars. Yes, they would be able to snatch it back from the perpetrator later, if he ever won the lottery, or raked it in by some drug deal or other illegal gain, or something. But I get the feeling that most of the folks who want to squeeze blood from a turnip against the evil perp are also the same folks who don’t want to pay taxes to support “social giveaway” programs like a victims’ fund. I don’t mind having my money go to support programs like that; if we believe crime victims deserve compensation, we must put our money where our mouth is.

Michael, I almost agreed with you, but there you go again with the hate…
No I would not give money to a victims’ fund through taxes – BECAUSE I AM ALREADY GIVING TO VICTIMS OF MUSLIMS DIRECTLY – and I am tapped out.
But what I would do is to direct ALL JUDGMENTS won by prisoners for civil rights abuses TO victims’ funds – AND – I would require ALL attorneys working on such cases to do so using private funds. NO ATTORNEYS FEES FOR SUING on behalf of a convict.
Just to be fair, I would reconsider said position on that happy day when US citizens suing prisoners GET FREE LEGAL COUNSEL!!!

Those are interesting proposals! Certainly within the realm of possibility, but in the real world I don’t think they have much chance of passage. I’m not saying the current system is perfect — just trying to accurately describe what it is, and how it works. And “the hate?” What hate? What did I say that you took as a personal attack on anybody? My apologies if you were offended.
And I would be perfectly fine if they passed a law creating a Public Victims’ Office, staffed by government-paid advocates to represent crime victims. Banning private counsel would be, though, a step too far, and probably against the Constitution. Even in Britain’s National Health Care system, for instance, rich people can go to a private doctor and pay out of their own pocket if they want to.

That’s not how US law works, Magical Girl. “If he didn’t want to get whipped daily and get fed only moldy bread and scummy water, he shouldn’t have done the crime.” The sentence of imprisonment means your freedom of movement is taken away, but prisoners still have rights, including the right not to be subjected to “cruel and unusual punishment,” in both federal and state systems (per the 14th amendment). Plus, the 2000 law cited in the article specifically requires prison systems to accomodate inmates’ reasonable religious practices.
I’m not saying prisoners should live in the lap of luxury. I was arguing with a bleeding-heart leftist on another forum the other day about Ahed Tamimi, the Arab teen who slapped an IDF soldier and got arrested for assault, and my interlocutor felt it was “like a Soviet gulag” to imprison teens. I told her that Israeli prisons were far from dungeons, and that even though the meals were not Michelin-guide quality, but cafeteria-style, she had nothing to complain about.
All I’m saying is, the law requires certain things, and those princjiples must be reasonably complied with. Otherwise, why bother to have laws? The laws limit and forbid the police and the jailer’s — and Congress, and the Presicdent’s — when they have a tendency to go to excessive extremes, just as much as they limit the perpetrators of the crimes that got them imprisoned in the first place. Nobody is above the law.

What about the rights of the rest of the prison population to be Halal free?
What of the rights of Americans to be free from funding nonsense – and frivolous lawsuits to enforce it?
What of the rights of victims and witnesses to sue these folks?
Why can’t they take the winnings from attorneys defending the violent, gang-run prison system?
Pardon me, but I think you doth protest too much. And accusing those of us WHO HAVE HELPED THE VICTIMS of being all sorts of unsavory innuendos just reinforces what our actual experiences have taught us: Democrats do not care about fixing the prison system, or making it more humane, or reforming prisoners, or protecting the rights and lives of those prisoners who are not part of a gang or follow a racist and supremacist ideology.
Giving Hate-Ideologies Free Speech and an opportunity to Freely Exercise that ideology is all well and good … but as you full well know, the First Amendment HAS been amended to allow for limitations due to circumstances, and as to time and manner, for the health, safety, and protection – and even mere convenience – of the public and public employees.
Given what I have seen of post-prison recidivism, I would have to say the Hotel Prison System is a complete failure. And from that alone, the prison system needs to try something different – like resisting racist and supremacist ideologies, gangs, and frivolous lawsuits. And the playing field should be leveled. Victims and witnesses should not have to struggle on MY nickels and dimes to just be heard – while pro-violence attorneys mock us and rape our public purse to pursue witless and unjust compensation for every perceived slight or subjective ‘offense.’
To conflate the ‘feelings’ of a convicted rapist with the actual concerns of real victims – as TORTURE – takes a tortured thought process to the extreme. Criminals and their attorneys get public funding, AND lucrative payouts from the public purse already – and if I do not GIVE as much – AS IF I HAVE IT TO GIVE? – justifies the abuse of the law-abiding public.
NO Michael – You come here to piss on people like me who have LOST relatives and friends and colleagues to Leftist and Islamist bull crap. To defend their hatred of us – and to spew on us – No way.

Ok, so non muslim prisoners are subject to cruel and unusual punishment by not being allowed equivalent privilege and consideration as muslims. Then there is the cruelty of the guards and prison staff granting special favours openly to muslims while non muslins are treated to the punishment of jail? There is a caste system in jail with muslims being the chosen favourites. The resentment towards islam is increased by this favouritism of muslims. The hate is growing, the politically correct do gooders are nurturing it.

Well,, that’s kind of partly true, but… we were talking about the law limiting police and jailer actions against suspects and convicts being held in official custody. Without going into great detail, it’s simply absurd to claim there are no legal or Constitutional limits on what the police and jailers can legally do — without being prosecuted criminally themselves, or sued by their victims, for exceeding those limits. That is beyond cavil.
As far as other areas in which you claim SCOTUS has “ruled that law enforcement has the right to break the law while enforcing the law” do you have a citation or a link? I can’t think of any examples other than obvious, trivial ones — traffic cops may speed to catch a speeder, for instance. What the cops CANNOT do to “break the law while enforcing the law” is violate the Constitution — illegal searches and seizures, improper arrests, etc. can not only get their cases thrown out of court as a result, they can lead to the cops getting sued, or prosecuted.
Congressional insider trading? That was not a case of legally “breaking the law” — it meant Congress had originally written the insider-trading law not to apply to themselves. That law was amended in 2012 to also make it apply to members of Congress.

In any event, Congressional insider trading does not occur “while enforcing the law” and does not arise to the level of a Constitutional violation of someone else’s individual rights — as 8th Amendment violations do.

Bill, thank you for the link, but I stand by my statements. The 2016 Strieff decision did NOT “ruled that law enforcement has the right to break the law while enforcing the law.” That is a sentence from the headline of the highly sensationalized news blog article you linked, along with this equally sensational sentence from the article itself: “Given the reality of the militarized police state rising up from the horrors of the war on drugs, the fact that cops can now legally act illegally to bust people for possessing arbitrary substances is chilling.”
What SCOTUS actually did was allow ONE, additional, tiny exception to the already-weakened “exclusionary rule” which was in any event a judge-crafted remedy for keeping the police in line when they perform an unconstitutional search or arrest, not a requirement of the Constitution itself.
That does not mean SCOTUS gave the cops “carte blanche” to do whatever the hell they want and get away with it, beating people up, denying them their civil rights.
But we weren’t discussing drug arrests and “the fruit of the poisonous tree.” We were discussing the treatment of prisoners and whether jailers had to acknowledge and respect prisoners’ constitutional (and statutory) rights, or risk getting sued. They must. End of story.

No, I am not a “Muslim sympathizer.” I’m an Orthodox Jew and a stanch Zionist. But I don’t see mis-statement or excessive stretching of the truth for propaganda value as a good thing regardless of which side is doing it. This article made it seem like there was something unusual about what this rapist convict did. There wasn’t. Suing the jailers over any old trivial (or otherwise) deprivation of their constitutional rights is a favorite pastime of convicted inmates, as you note.

I tried the orthodox brand, but it raised too many inconvenient questions, after the drugs wore off. I tried the reform brand, but I find it hard to believe God wants me to pay thousands every year to join their synagogue –I would think God would want me to worship Him anyplace & anytime & I really doubt He would require me to pay for the privilege/opportunity
Far as what the rapist did, I have visited the jail for a few days in the past and I don’t see anything wrong with asking for stuff nobody will give you. In fact if you want something while you are in jail, just trade for it, or buy it from the guards–they are the ones who smuggle in most/all of the contraband…

So right. Whatever you want, from hard drugs to cell phones (forbidden, in most prisons), the guards can get them for you, for the right kind of baksheesh.
The kicker in this case is that the prison DOES provide kosher meals, and the rapist DOES agree that this would satisfy his halal needs, but for some cockamamie reason, the warden won’t give it to HIM — why, because he’s not Jewish? As though he were just some random punk trying to get perks that he thought were better than the ordinary prison fare? (Convicts do that, too, you know.) He’s not. He’s got a legitimate, religious reason. And it makes no sense the prison administration would not just give him one of the kosher meals they already prepare and serve to Jewish inmates, for the same reason they do THAT.– to satisfy the requirements of the 2000 Act. That’s why he sued — the warden was being an idiot.

I wonder how many “Christians” inmates there are in the system? They have a chapel and a priest preaching to these criminals “Christians” too? Am I correct? Then serve them all dry pig extrement biscuits too and see what the response of the “Christian” inmates. My best bet is that more than 90% of these criminals profess to be “Christians” with some atheist and agnostics. So for the “Christians” it is alrite to be rapist, murderers, robbers, but not for Muslims? In a Muslim country they would already lose their head for rapes but in America they are jailed for 10-15 years to repeat another rape since it is alrite for “Christians” to do it. No one is executed for rape in s-hole countries. And in Muslim countries, the situation is worse. Rape is so common in most Muslim countries it is not considered a crime. Women are executed for adultery or prostitution, but generally those executed for ‘rape’ are the victims of the rape and not the rapist.

It’s what the law requires. Are you saying judges should ignore the law? The 2000 Religious Land Use and Institutionalized Persons Act had broad bipartisan support. In other words, religious Christian conservatives helped pass that law.
It does not seem like BS to me to say that state and local governments should not be permitted to oppress religious believers by, say, imposing unreasonable zoning requirements on the location of churches and other places of worship (one of the subjects of this law), or forcing prison inmates to be denied the right to practice their religion (another subject of that law).
How would you feel if some prison systems refused to allow Protestant inmates to keep a Bible or prayer book in their cell? Some used to do that. How about back when Catholics were forbidden to eat meat on Fridays? Should they just be stuck, too, if the jail didn’t offer an alternative protein and just said, “eat your vegetables cooked in lard?” It’s not just Muslims that the law protects.

Do the prisons require all inmates to be clean-shaven? Seems I have seen inmates with beards before, and one thing about the muslim faith is that the men are supposed to grow their facial hair while women are required to hide their faces and cover their hair. He wants halal, give him halal – just make it pork products.

You know what? I don’t see any problem with this. As a laywer, I have represented Jewish inmates who had to sue to get Kosher meals, before the 2000 law was passed. This inmate has agreed that Kosher meals would satisfy his Halal requirements, and the prison actually does offer a Kosher option, but is not willing to give this inmate Kosher meals. That’s just petty, and, it’s against the federal law. The “vegetarian option” is inadequate, just as it would be for a Jew demanding Kosher meals, if the kitchen staff allows their utensils, or their unwashed hands, to come into contact with his vegetarian meal after handling non-Kosher, non-Halal meats. His demand is not unreasonable.
The nature or severity of his crime has nothing to do with it. This is a mater of prisoners’ rights, and I’m 100% behind him on this. It would take zero additional effort for the Oregon prison system to give this guy Kosher meat meals.

If prison is meant to REFORM prisoners, their Hate Ideology needs to be replaced. This means the Guards need to be in charge, and not the Gangs. But that would require severe measures to modify the behavior of the inmates, segregation of the insane, and NO LEFTISTS IN SIGHT.

Islam is popular in prison because making demands on staff is always popular with inmates. Islam provides a religious sanction for making demands. Once Oregon Corrections caves on this, and they probably will, there will be yet another demand. And another after that. Islam provides a ready made template for making demands on the kuffars and most prison systems base their policy on lawsuit avoidance. Eventually, Oregon will have to draw the line after much consultation with attorneys.
