Big cases, retirement rumors as Supreme Court nears finish

WASHINGTON (AP) — The Supreme Court enters its final week of work before a long summer hiatus with action expected on the Trump administration’s travel ban and a decision due in a separation of church and state case that arises from a Missouri church playground.

The biggest news of all, though, would be if Justice Anthony Kennedy were to use the court’s last public session on Monday to announce his retirement.

To be sure, Kennedy has given no public sign that he will retire this year and give President Donald Trump his second high court pick in the first months of his administration. Kennedy’s departure would allow conservatives to take firm control of the court.

But Kennedy turns 81 next month and has been on the court for nearly 30 years. Several of his former law clerks have said they think he is contemplating stepping down in the next year or so. Kennedy and his clerks were gathering over the weekend for a reunion that was pushed up a year and helped spark talk he might be leaving the court.

“Soon we’ll know if rumors of Kennedy’s retirement are accurate,” one former Kennedy clerk, George Washington University law professor Orin Kerr, said on Twitter Friday.

When the justices take the bench Monday, they are expected to decide the case of Trinity Lutheran Church of Columbia, Missouri, which was excluded from a state grant program to pay for soft surfaces on playgrounds run by not-for-profit groups. The case is being closely watched by advocates of school vouchers, who hope the court will make it easier to use state money to pay for private, religious schooling in states that now prohibit it.

Missouri has since changed its policy under Republican Gov. Eric Greitens so that churches may now apply for the money.

Also expected in the next few days, though there’s no deadline by which the court must decide, is a ruling on whether to allow the administration to immediately enforce a 90-day ban on visitors from six mostly Muslim countries.

Justice Neil Gorsuch, Trump’s first Supreme Court nominee, could play a pivotal role in both the travel ban and church playground cases.

Ginsburg needs to retire also.. She has openly advocated adherence to international law over the US Constitution, among other perversions. But this will not end the PC spread of preferential treatment of Muslims sweeping the nation, since there is still enough of the enemy in lower positions of authority who won’t do the right things for the nation.

And she it always sleeping when we see her. Senile. Enough is enough. Trump should make a limit for these idles to sleep in the Court. 5 yrs maximum. It’s ridiculous! 30-40 yrs on the same position! It’s the path to corruption.

Agreed. She should recuse herself from the travel ban case due to some very personal insults she has made against Trump, showing a personal bias against him. After all, she may try to use his campaign rhetoric against him but look who’s talking. Besides, she is two days older than dirt.

This is excellent news and one of the reasons why I voted for Trump. If Kennedy retires, he will be replaced with a conservative.

Ginsburg made a mistake by not retiring and having ObaMao pick her replacement. I guess she was counting on another DIMocrat president or more likely was counting on a woman president to replace her. So, because of her selfishness, it looks like Trump may be picking her replacement because she is way past her expiration date. Hell, she looked past her expiration date the day she was sworn in!

I think they were so certain that they would be able to place a Dem in the WH after Obama, it didn’t seem critical to replace Ginsburg at the time.

Of course, and that’s why old bat Ginsberg told the AP last July that she refused to even think about the possibility of a Trump victory. In an interview with the New York Times, she said she couldn’t imagine what the country and the Supreme Court would be like if Trump won. “For the country, it could be four years,” she said. “For the court, it could be — I don’t even want to contemplate that.” She also called Trump a “faker” during an interview with CNN. “He has no consistency about him. He said whatever comes into his head at the moment. He really has an ego,” she told CNN, questioning how Trump had gotten away with not turning over his tax returns. Trump called the justice’s comments “highly inappropriate” in an interview with the Times and took to Twitter to call for her resignation.

Ginsburg’s ugliness about Trump later backfired, with some critics saying she had crossed the line. She later said she regretted getting caught making the comments but fell short of apologizing.

She should recuse herself from any cases involving Trump executive orders or the travel ban, since she’s shown herself to be irreconcilably biased against Trump, but she won’t. Libturds never recuse themselves, just suckers like Jeff Sessions.

I had forgotten that. Sadly, it also suggests that Batty won’t be retiring soon. Maybe the stress of seeing Obama’s policies demolished will push her over the edge.

Ginsburg and Pelosi both need to be relegated to a retirement home. Perhaps they can share a room? Put them both on meds to keep them docile and quiet.

I write to suggest that President Trump, in an effort to bring the country together, nominate Judge Merrick Garland, a brilliant jurist and mensch. Just because Judge Garland was previously nominated by Pres. Obama should not count against him.

Judge Garland, summa cum laude graduate of Harvard College and magna cum laude graduate of Harvard Law School, would be a thoughtful Associate Justice committed to the Constitution as a living document.

The Democratic leadership would be dumbstruck by such a brilliant and unexpected nomination. Indeed it would get two birds with one stone: President Trump needs positive media attention. And such a bold stroke would help put behind him the cloud of Russian collusion.

Uh – NO!

The constitution is not a “living document” and we don’t need judges to make it such. The proper way to change the constitution is through the amendment process, which the founders made intentionally difficult.

Also – just because someone graduated with honors from Haaaavaaaahd, doesn’t qualify them for anything IMO. Ivy league graduates have been destroying this country for several decades.

That would make the President’s promises of pro-life Supreme court justices outright lies and a betrayal of his constituency. President Trump’s voters love him because he promised to work for them and enact regulations and appoint people who are will benefit all Americans not left wing hate groups like the Democrats and their activist groups like the Klu Klux Klan, Black Lives Matter (who caused 10 cops to be shot, 6 of them black), and the anti-fa who are the young brutal facists of our time.

This is a terrible suggestion. If Judge Garland was any where near being acceptable, Obama would never had nominated him. Although Obama knew his nominee would probably not get a hearing (thank God) he still picked a reliable liberal toadie–exactly what you get from Haahvaad and the elite establishment. Isn’t it about time a Supreme Lawyer came from somewhere out in Common-sense Land instead of the F****d up Ivy league.
