Muslim activist threatens to SUE after being handcuffed for refusing Staten Island Ferry bag check

“I have no doubt that many (people) are in fact stopped randomly, but the manner this was done in my particular case made it feel different.”

Nonsense. Anyone can get checked. The NYPD is very careful, in today’s politically correct environment, not to single out Muslims. El-Meligy is just trying to make it impossible for Muslims to be checked at all. Then jihadis can go about their business without fear of being stopped before they can commit mass murder. Is that what he wants?

Story continues below advertisement

“Activist is handcuffed after refusing Staten Island Ferry bag check,” by Kyle Lawson, Staten Island Advance, March 9, 2017:

STATEN ISLAND, N.Y. — A religious and political activist on Staten Island claims he was placed in handcuffs, frisked and issued two summonses by NYPD officers based on the way he looks.

Hesham El-Meligy, a Muslim who was born in Egypt, was temporarily detained and searched by police at about 8 a.m. Wednesday at the Staten Island Ferry terminal in St. George, after he refused a random bag check.

After a search of his backpack, he was issued summonses for trespassing and disorderly conduct and allowed on to the ferry, police said Thursday.

El-Meligy, founder of the Islamic Civic Association on Staten Island and chairman of the Staten Island Libertarian Party, said he believes the bag check wasn’t so random.

He took to Facebook hours after the incident, saying he felt singled out because his Egyptian heritage.

“I have no doubt that many (people) are in fact stopped randomly, but the manner this was done in my particular case made it feel different,” said El-Meligy.

He said there were at least five people in front of him carrying purses and backpacks when an NYPD officer walked in to the crowd, extended his arm and ordered him to a table for a bag search.

“I said ‘no thank you,’ said El-Meligy. “He replied that he’s not asking me, but telling me, and I replied again, ‘no, thank you.'”

A spokeswoman for the NYPD said there’s no set guidelines as to which passengers are selected, such as every fifth or tenth person.

“There’s no science to it,” said Det. Kellyann Ort. “It’s like flipping a coin.”

She said El-Meligy was not personally selected.

“Many other people had their bags checked during that same time frame.”

But El-Meligy argued police were in violation of the Fourth Amendment.

The Amendment protects the right of the people against “unreasonable searches and seizures… and no Warrants shall issue, but upon probable cause.”

NYPD policy states a passenger is not required to hand over their bag, however, they would have to find an alternate form of transportation.

A policy that El-Meligy said also is a rights violation.

“It is an infringement of my right to travel freely without molestation and due process of the law.”…

In an emailed statement from the New York Civil Liberties Union in regard to the incident, Associate Legal Director Christopher Dunn wrote the following:

“The NYPD cannot single out Muslims, or people police perceive to be Muslims, for bag checks.”

El-Meligy said Thursday he was in the process of seeking legal counsel….

He said after he was searched, he engaged in dialogue with the officers about how the ferry terminal is a “government (public) travel facility, not a privately owned building where the owner has the right to discriminate against who they allow in.”

“We engaged in a deeper discussion about this and related issues, and at the end I hugged the few officers who were there and told them again that it is not personal.”

Why would a person refuse to have bags checked when traveling anywhere, by bus, plane, car, train, ferry? It is a common thing. We are all aware there is terror activity in whole world. In America, the rules should be for everyone, nobody is special. You don’t like it, go back where you came from.
I would never complain if I was checked. In fact, I would be pleased people doing their job.

Exactly. I went to the movies a few weeks ago and had to open my purse to show I wasn’t carrying a weapon. I didn’t raise a fuss and was glad they were taking steps to protect us.

Say hello to America’s next millionaire. CAIR is already lawyering up
for a massive discrimination lawsuit. These guys have this scam
mastered!

I wish there really were a Muslim ban! This El-Meligy chap is a an extremely sly and clever manipulative Muslim piece of trash. You really have to admire the Muslim’s cunning tactics and the skill with which they apply them. It’s more powerful than even a Jedi mind trick. These con artists are slick! They always manage to masterfully turn themselves into victims.

This supposedly “priveledged” because I am white person that I am, was made to remove the knee length braces that I wear inside my shoes on both legs so they could be scanned while I stood without my braces to be groped, risking breaking bones. I hadn’t even left the country. The young women felt bad and was quite apologetic. I didn’t raise a stink. Although had a bone broke, there would have been a law suit. If I can tolerate that, Mr. Whiny can jolly well shut up.

God took good care of me, the pat down went quick and it was a young woman, who was as uncomfortable as I was and apologetic. The rest of my trip was very enjoyable. It was my third time flying my first time since 9/11, alone and disabled from a car accident. I found my fellow travelers to be friendly, kind and very helpful people. I flew United and American on this trip. United was not as helpful and friendly as American, but I wouldn’t trash them either. Trust God to help you and choose to have fun no matter what. I would do it all again! Go see your boys.

This law, that NYC is using called “stop and frisk” is indeed “Unconstitutional”. IF this law went to the supreme court today, It Would loose the case. I agree, that he is probably just trying to use his birthplace as a reason to make a fuss, but I disagree even more with the “POLICE STATE” actions NYC especially has been using. It’s a VERY severe erosion of the constitution.

“A religious and political activist” born in Egypt. We are entitled to ask the same questions we have asked a thousand times: why was he given citizenship? What did the authorities decide he could contribute to predominantly white, Christian, democratic America? Did they not consider that he might fail to integrate and become a disruptive, potentially dangerous Muslim “activist”? The answer, of course, is in the insanity of the multiculturalism fantasy that different cultures and religions can all live side by side in one big harmonious melting pot. Despite all the evidence to the contrary, politicians, liberals and the media refuse to abandon that fantasy and continue to push for more and more immigrants from the two cultures most alien to our own: Muslim and black African.

I agree it’s no fun going through checks but since 911 we have to undergo all sorts of restrictions he can thank his fellow Muslims for that. Instead of viewing this for what it is Security in a world full of terrorism ! He should be grateful were trying to keep his muzzle butt safe too! If you resist having a bag check it looks suspicious and it doesn’t matter if it’s an airport ferry train or bus depot! It’s the world we live in NOW!
The appearance of this man doesn’t scream middle eastern Muslim he could easily be Greek or Italian by physical appearance so no it’s not personal it’s necessary. He is just looking for money and a sob story for attention!!! Oh look at me poor Egyptian man being singled out. Hope they have it on tape so they can prove how randomly they do this and because it’s so random and this has happened they will turn around and make it everyone gets checked just like in airport and court houses etc. Which means long waiting lines !
